Resolution 717 RESOLUTION NOo 717 RESOLUTION OF THE COUNCIL OF THE CITY OF GilROY DECLARING PUBLIC NECESSITY FOR ACQUISITION OF REAL PROPERTY FOR A FIRE STATION AND AUTHORIZING THE CITY ATTORNEY OF THE CITY OF GILROY TO INSTITUTE PROCEEDINGS IN EMINENT DOMAIN THEREFORo BE I T RESOLVED: That the Council of the City of Gilroy does hereby expressly find and determine that the public interest and necessity requires the construction and maintenanee of a fire station and for the housing of fire prevention and firefighting equipment therein, on the premises hereinafter described, and that the said described property and the whole thereof is necessary for the purpose of constructing and maintaining thereon said fire station and for the housing of the equipment therefor, and that the proposed improvement is located in a manner that will be most compatible with the greatest public good and the least private injury. That said real property hereinabove referred to is that certain parcel of land constituting one contiguous tract, lying in the the County of Santa Clara, State of California, partly within and partly without the said City of Gilroy, and being more particularly described as follows, to wit: '~EING a portion of Lots 14 and 15 as shown on map entitled IIMap of Henry Miller1s Subdivision of Las Animas Ranchlot 23", which map is recorded in Book IIHII of Maps at page 5, Records of Santa Clara County, California, and being more particularly described as follows: IIBEGINNING at a point in the centerline of Wren Avenue shown as Avenue I'HII on said map distant thereon S. 10 W. 168.16 feet from the corner common to Lots 6, 7, 15, and 16 and run- ning thence N. 890 w. 263.00 feet; and thence parallel with the centerline of Wren Avenue S. 10 w. 221.84 feet; thence S. 890 E. 263.00 feet to a point in the centerline of Wren Avenue; thence along the centerline of Wren Avenue N. 10 E. 221.84 feet to the point of beginning, and CONTAINING THEREIN 1.339 acres gross and 1.171 acres net, ex- clusive of the Westerly half of Wren Avenue contained within the above description.1I BE IT FURTHER RESOLVED: That the City Attorney for the City of Gilroy be, and he is hereby empowered and authorized to institute suit in eminent domain in the Superior -1- 7/ '7 Court of the State of California, in and for the County of Santa Clar9, against w. B. STUART and any and all other parties who have or claim any interest in the above-described property, for the purpose of condemning, as provided by law, the hereinabove described property and the whole thereof, and all the right, title and interest of any parties therein, in order that the said City of Gilroy may acquire a fee simple title to said property for the uses and purposes aforesaid, and that the Mayor and/or City Clerk of the City of Gilroy and other employees and officers of the City of Gilroy be, and each of them is hereby, authorized, empowered and directed to verify such pleadings and make such affidavits as to facts within their knowledge, requisite to be done in connection with the institution and prosecution of said suit in eminent domain, and that the said Mayor and City Clerk and/or other officials authorized to do so, are hereby authorized, empowered and directed to draw such warrants in such amounts as may be required by said Court, in order that said City of Gilroy may deposit such money in said Court, and may then take immediate pos- session of said lands hereinabove described, for the uses and purposes herein- above set forth, in accordance with the provisions of Article I, Section 14, of the Constitution of the State of California.
