RESOLUTION NO. 79 - 11
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ORDER-
ING VACATION OF THE SOUTHERLY 170 FEET OF THE PUBLIC
ALLEY FROM FIRST STREET TO SECOND AND EIGLEBERRY
STREETS, RESERVING TO THE CITY EASEMENTS FOR ALL PUBLIC
FACILITIES.
WHEREAS, the Council of the City of Gilroy did on June 5,
1978, adopt Resolution No. 78-33 declaring its intention to proceed
under the Street Vacation Act of 1941, Streets and Highways Code
Section 8300, et. ~ to vacate the southerly 170 feet of the
alley from First Street to Second Street between Monterey and Eigle-
berry Streets, but not the public facility easements, as shown upon
the map attached hereto and
WHEREAS, notices of the adoption of such resolution were pub-
lished and posted as required by law, and
WHEREAS, no objection to the proposed vacation of the portion
of public alley was filed at or before the hearing by the Council
on July 5, 1978, at 8:00 p.m. in the Council Chambers in the City
Hall at 7390 Rosanna Street, Gilroy, California, the time and place
fixed for the hearing in said notices, and the hearing having been
duly held, and the Council having duly considered the evidence pre-
sented as to the vacation of the portion of the public alley des-
cribed herein;
The Council does hereby find that the described portion of
the public alley is unnecessary for present or prospective public
use.
The Council further finds that public convenience and neces-
sity require the reservation of easements enumerated in Streets and
Highways Code Section 8330 for all public facilities across, above
and under the described easement.

NOW, THEREFORE BE IT RESOLVED by the Council of the City of
Gilroy that the described strip of land be vacated, but that per-
manent easements for all Dublic facilities enumerated in Streets
~
and Highways Code Section 8330 across, above and under the described
strip of land be reserved to the City as shown upon the map attached
hereto.
