RESOLUTION NO. 79 - 3.5
RESOLUTION OF INTENTION TO VACATE A PORTION OF NINTH STREET BET-
WEEN RENZ LANE AND U. S. HIGHWAY 101, RESERVING TO THE CITY EASE-
MENTS FOR PUBLIC FACILITIES.
WHEREAS, that portion of Ninth Street between Renz Lane
and U. S. Highway 101 in the City of Gilroy is unnecessary for
present or prospective public street purposes and should be vaca-
ted, but that public convenience and necessity require the reser-
vation of easements for all public facilities.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Gilroy that it does hereby declare its intention to vacate
the portion of Ninth Street between Renz Lane and U.S. Highway
101, reserving to the City all easements for public facilities
set forth in Streets and Highways Code Section 8330.
BE IT FURTHER RESOLVED that this Resolution shall be
published and said street posted as required in the Street Vaca-
tion Act of 1941, under which this proceeding is instituted, and
the 4th day of June, 1979, at 8:00 o'clock p.m., or as soon there-
after as the matter can be heard, in the Council Chambers, City
Hall, 7390 Rosanna Street, Gilroy, California, is hereby designa-
ted as the time and place at which said City Council shall hear
any and all persons interested in or who may object to the pro-
posed vacation.
One publication of said notice shall be made in the
Gilroy Dispatch, a newspaper published in the City of Gilroy,
at a date at least ten (10) days prior to the time of hearing.
PASSED AND ADOPTED this 7th day of May, 1979, by the
