RESOLUTION NO. 79-46
RESOLUTION OF THE CITY OF GILROY APPROVING A C1 and R3
PLANNED UNIT DEVELOPMENT PERMIT, SUBJECT TO COHPLIANCE WITH
THE PLANS, SPECIFICATIONS AND DESIGNS FILED WITH l~E
APPLICATION AND TO BE FILED AND APPROVED, AND THE CONDITIONS
n\~OSED HEREIN, FOR DEVELOPMENT OF Tr~T 5 ACRE PARCEL LOCATED
ON THE NORTHWEST CORNER OF KELTON DRIVE AND FIRST STREET
WHEREAS. TOM H. and GRACE C. KANANO have heretofore filed with
the Planning Connnission of the City of Gilroy application Z 79-7
requesting approval of a Planned Unit Development permit for C1 (Neighbor-
hood Commercial) and R3 (Low Densi.ty Multiple Family) development of
5 acres of property located on the northwest corner of Kelton Drive and
First Street. and
WHEREAS, the Planning Connnission of the City of Gilroy has given
due notice of a public hearing upon the said application, in accordance
with the Zoning Ordinance of the City of Gilroy, has held the hearing,

has approved a Negative Declaration under the California Environmental
Quality Act and has made its report to the Council of the City of
Gilroy, in which it reconnnends approval of a C1 and R3 Planned Unit
Development permit, subject to certain conditions, and
WHEREAS, the Council of the City of Gilroy has fixed the 21st day
of May, 1979, at the hour of 8:00 0.c1ock p.m. in the Council Chambers
in the City Hall at 7390 Rosanna Street, Gilroy, California: as the
time and place for hearing the said report and recommenda. on upon the
said application, and notice of the said hearing has been given in
accordance with the said Zoning Ordinance, and a public hearing has
now been held upon the said application, at the time and place fixed
in the said notice, before the Council, and the Council having duly
considered the said application and the evidence presentee:., the
Council does hereby determine:
1. That the Council approves the Negative Decla:t'ation under th,:,
California Environmental Quality Act.

2. That the Council approves and adopts the findings of the
Planning Commission set forth in its Resolution No. 79-25.
3. That Planned Unit Development permit be granted subject to
the conditions set forth below.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GILROY that a Planned Unit Development permit be granted for the
premises described below, subject to the following conditions:
(1) That the Planned Unit Development permit be issued
for Cl and R3 development, subject to the condition
that all improvements are to be constructed in accord-
ance with plans, specifications, designs, and land-
scaping filed with and approved by the Planning Commission
and the Councilor no building permit be issued.
(2) Specific site, building and landscape plans for the
racquetball/health club shall be submitted to the
Architecture and Site Committee for approval.
(3) The future commercial and residential phases of this
project shall be reviewed and approved by the Planning
Commission and City Council as amendments to this PUD
request.
(4) The residential development phases of this project shall
not be exempt from the requirements of the City of Gilroy
Residential Development Ordinance (RDO) if adopted prior
to submittal of the residential development phases of this
proj ect.
(5) The access right-of-way shown across the property shall be
a public roadway easement with a 60 foot right-of-way for
ingress, egress and utilities. This public roadway ease-
ment shall be aligned opposite the alley as it enters onto
Kelton Drive.
(6) A 15 foot wide emergency access shall be provided along
the western boundary of Parcel 2.
(7) Full street improvements (street. curb, gutter and side-
walk) shall be provided along the entire Kelton Drive and
First Street frontage upon initial development.
(8) The driveway access for the commercial area shown on the
plans shall be determined when the commercial development
plans are reviewed by the Planning Commission and City
Council.
(9) The northernmost portion of the property shall be single
story.
BE IT FURTHER RESOLVED that upon completion of all phases of con-
struction. the entire premises be rezoned C1 and R3 as developed.

The said premises hereinbefore mentioned are described as follows:
Located in the City of Gilroy, County of Santa
Clara, State of California, to wit:
That five acre parcel at the northwest corner of
Kelton Drive and First Street being Santa Clara
County Assessor's Parcel No. 790-39-021.
PASSED AND ADOPTED on the 4th day of June, 1979, by the following
