A RESOLUTION PROVIDING FOR THE ALTERATIONS OF THE
BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION
THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED
AS "PACHECO PASS ANrmXATION 79-3 TO THE CITY OF
GILROY"
\lHEREAS, a written petition has been filed in the office of the
City Clerk of the City of Gilroy in accordance with the provisions of
the "Municipal OrganizationAct~of 1977". asking that there be annexed
to the City of Gilroy certain uninhabited territory located in the
County of Santa Clara, State of California, hereinafter more particularly
described; and
~ffiREAS. said petition has been signed and consented to by the
owners of all of the land in the territory proposed to be annexed and
said territory is contiguous to the City of Gilroy; and
\nIEREAS, an application for annexation of the said premises has
been filed with the Santa Clara County Local Agency Formation Commission.
and said Commission did make its determination upon the proposed annex-
ation, and has approved and authorized said annexation as proposed
pursuant to section 35157 of the Government Code; and
WlIEREAS, pursuant to Section 35151 of the Government Code the
terrritory is to be annexed without notice and hearing, and without
an election.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GILROY AS FOLLOWS:
Section I: Under the authority of the said "Municipal Organization
Act of 1977", and Section 35221 of the Government Code of the State of
California, there is hereby annexed to the City of Gilroy the uninha-
bited territory particularly described as follows:
BEING a portion of Las Animas Ranch Lot 44 as shown on Map No. 7
accompanying the Final Report of the Referees in the Las Animas
Rancho Partition Suit, Action No. 5536 had in the Superior Court
of the State of California. in and for thr County of Santa Clara,
and being more particularly described as follows:

BEGINNING at the southwesterly corner of Pacheco Pass
Annexation 76-2 to the City of Gilroy as described in
Ordinance No. 76-11 of said City adopted July 19, 1976,
in the line comrnon to Ranch Lots 43 and 44 as shown on
said Hap No.7, said point of beginning being also the
most easterly corner of that certain parcel of land
conveyed to the State of California by Josie Fazio,
ct aI, by deed recorded July 12, 1967 in Volume 7680
at page 394, Official Records of Santa Clara County,
and running thence along said lands conveyed to the
State of California northwesterly along a curve to the
right with a radius of 347.00 feet, from a tangent
bearing of N.77058'3711W.. through a central angle of
550l2'l3" for a distance of 344.33 feet; thence
N.22046'24"H. 135.36 feet to an intersection with the
southeasterly line of Pacheco Pass-Ninth Street
Annexation to the City of Gilroy as described in
Resolution No. 1041 of said City adopted July l5, 1966;
thence along said southeasterly line N.7004l'lO"E.
163.22 feet to the most westerly corner of Pacheco
Pass Annexation 70-6 to the City of Gilroy as described
in Ordinance No. 888 of said City adopted June 15, 1970;
thence along the southwesterly line of said annexation
S.50043'47''E. 129.51 feet; thence along a tangent curve
to the left with a radius of 217.80 feet. through a
central angle of 15021' for a distance of 58.35 feet
to the most northerly corner of said Pacheco Pass
Annexation 76-2; thence along the westerly line of
Pacheco Pass Annexation 76-2 and the line connnon to
Ranch Lots 43 and 44 S.0048'W. 271.43 feet to the point
of beginning. and
CONTAINING THEREIN l.656 acres. LM/DC
Section II: The said territory hereby annexed to the City of
Gilroy is hereby designated as "PACHECO PASS ANNEXATION 79 -3 TO
THE CITY OF GILROY".
Section III: This annexation shall take effect on the date of
the recordation of a certified copy of the certificate of completion
with the county recorder pursuant to Section 35354 of the Government
Code.
PASSED AND ADOPTED this 16th day of July, 1979, by the following
