RESOLUTION NO. 79-96
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
APPROVING A TENTATIVE MAP FOR A 45 UNIT CONDOMINIUM
ON THE SOUTH SIDE OF BUTTERCUP LANE BETVlEER WESTWOOD
DRIVE AND KERN AVENUE.
lnIEREAS, application ~1 79-3 has been made by ~ruSSALLEM
DEVELOPMENT CORPORATION to the Planning Commission for approval
of a tentative map for a 45 unit condominium on the south side of
Buttercup Lane between Westwood Drive and Kern Avenue, and
WHEREAS, after a public hearing the Planning Commission
has approved a Negative Declaration under the California Environ-
mental Quality Act and has passed Resolution No. 79-56 in which
it recommends approval of the tentative map subject to two con-
ditions, and
WHEREAS, the Council has held a public hearing on the
application and has considered the Planning Commission recommen-
dation and the evidence presented;
NOW THEREFORE, BE IT RESOLVED by the Council of the City
of Gilroy that:
1. The Negative Declaration is approved in that the
development will not have a significant adverse effect on the
environment.
2. The tentative map is approved with the following
conditions:
(a) The developer shall negotiate rights-of-
way with P.G. & E and other utilities.
(b) Individual condominium units shall be
owner-occupied for a minimum of one year.

(c) A complete landscaping, irrigation and
maintenance plan shall be submitted and approved
by the Director of Planning prior to occupancy.
PASSED AND ADOPTED this 19th day of November by the
