RESOLUTION NO. 79 - 105
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY OF
AGREEMENT TO REVENUE AND TAXATION CODE SECTION 99 FOR
EXCHANGE OF PROPERTY TAX REVENUES FOR TERRITORIES AFFECTED
BY A JURISDICTIONAL CHANGE.
WHEREAS, subparagraph (b) of Section 99 of the Revenue
and Taxation Code requires that the Board of Supervisors
negotiate an exchange of property tax revenues with the City
for territory affected by a jurisdictional change; and
WHEREAS, the cities and county wish to facilitate
orderly and expeditious jurisdictional changes; and
WHEREAS, the cities and the county have reached agree-
ment pursuant to the above referenced code section;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Gilroy that the annexing city shall receive
the proportion of the one percent (1%) property tax revenue
previously received by the detaching special districts, but
not less than the proportion of the property tax received by
the city in that city's tax rate area composed of the same
jurisdictions receiving a portion of the one percent (1%)
property tax;
BE IT FURTHER RESOLVED that this distribution formula
shall be applied to jurisdictional changes which were effec-
tive during fiscal year 1978-79 pursuant to subparagraph (d)
of Section 99 of the Revenue and Taxation Code; and
BE IT FURTHER RESOLVED that this distribution formula
shall be applied to all pending and future jurisdictional
changes; and

BE IT FURTHER RESOLVED that the County Auditor be
notified of this resolution pursuant to subparagraph (b) of
Section 99 of the above referenced Code.
BE IT FURTHER RESOLVED that this action is taken by
the Gilroy City Council subject to all other Santa Clara
County Cities joining in under the same pro-rata tax rate
adjustment.
