Resolution 1979-106 ,- ',- ,e e -- RESOLUTION NO. 79-106 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DECLARING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS IN R3 AND R3X DISTRICTS UNTIL JULY I, 1980. Upon recomnlendation of the Council Growth Management Committee, and good cause appearing therefor: BE IT RESOLVED by the Council of the City ot Gilroy that: The City Council declares a moritorium until July 1, 1980, with certain exemptions/on multiple family residential construction on those properties now zoned R-3 and R3X which are designated low- density residential in the new General Plan adopted November 5, 1979. These properties are generally located between Hanna and Monterey Streets, and First and Tenth Streets on the west side, and in various locations on the east side. Intent 1. To assure conformance with the General Plan. 2. To clarify status of these properties for the benefit of the Building Department, Planning Department, Planning Commission, property owners, developers, realtors, etc. 3. To protect the rights of property owners by allowing legiti- mate, previously planned, proposals to proceed. 4. To keep the pipeline short. Exempted Projects 1. Those holding valid building permits. 2. Those where application has been made or approval received from Architectural and Site Committee and/or the Planning Commission (subject to all other requirements). 3. Those specifically exempted by the Planning Commission (with appeal possible to the City Council). Exemptions could be granted based on: a. Recent purchase (but prior to imposition of moratorium) of property by builders, developers, etc. with the clearly demonstrated intent of constructing multiple residential units. b. Proven progress on surveys, architectural plans and/or financing arrangements. c. Replacement of structures condemned by the building depart- ment. Sound structures, particularly those of historical value, shall be preserved. d. Meeting of criteria for exemption from the Residential Development Ordinance. e. Other proven hardship. RESOLUTION NO. 79-106 -1- .. e e Time Constraints 1. All exemptions must be granted prior to general rezoning to R-l of lands in these areas so designated on the General Plan. 2. Building permit applications for exempted projects must be submitted prior to July 1, 1980. If not, property will then be rezoned R-l.
