RESOLUTION NO. 81-30
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
RESCINDING ON REQUEST FOR REHEARING ITS RESOLUTION
NO. 81-20 AND GRANTING ON APPEAL, A CONDITIONAL'USE
PERMIT FOR MONTEREY PLAZA PARKING.
WHEREAS, DON CAMPAGNA, INC. requested a rehearing on
City Council Resolution No. 81-20 denying a use permit for
parking at MONTEREY PLAZA CENTER; and
WHEREAS, the request for rehearing was granted and has
been held on April 6, 1981 at 8:00 p.m. in the Council Chambers
in the City Hall at 7351 Rosanna Street, Gilroy, California; and
WHEREAS, in connection with said rehearing, the issue arose
as to whether additional commercial parking would be permitted
on adjacent land if parking could be provided on-site for office
use; and
WHEREAS, evidence was submitted on the issues, after due
consideration, the City Council finds;
1. That the building will be designed to fully
conform to all present ordinances including
the requirements for total on-site parking as
an office building.
2. That the present need for additional parking
spaces be allowed on adjacent land owned by
Southern Pacific Land Company for commercial use.
3. That if the lease with Southern Pacific Land
Company is ever terminated, the existing retail
leases in the center would themselves terminate
within one (1) year with the spaces reverting to
offices to meet parking requirements.
NOW THEREFORE, BE IT RESOLVED that the City Council of
the City of Gilroy does hereby determine on rehearing this appeal
that the conditional Use Permit be granted subject to the above
conditions.
