RESOLUTION NO. 81 - 32
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ORDERING VACATION
OF A PORTION OF SIXTH STREET, AT ITS HOST EASTERLY TERHINUS, RESER-
VING TO THE CITY EASEMENTS FOR ALL PUBLIC FACILITIES.
WHEREAS, the Council of the City of Gilroy did on tAarch 16,
1981, adopt Resolution No. 81-26 declaring its intention to proceed
under the Street Vacation Act of 1941, Streets and Highways Code
Section 8300, et. ~ to vacate the most easterly portion of
Sixth Street, but not the public facility easements, as sho~~ upon
the map attached hereto; and
WHEREAS, notices of the adoption of such resolution were
published and posted as required by law; and
WHEP~AS, no objection to the proposed vacation of the most
easterly portion of Sixth Street was filed at or before the hearing
by the Council on April 6, 1981, at 8:00 otclock p.m., in the Council
Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California,
the time and place fixed for the hearing in said notices, and the
hearing having been duly held, and the Council having duly considered
the evidence presented as to the facation of the most easterly portion
of Sixth Street described herein;
The Council does hereby find that the described portion of
Sixth Street is unnecessary for present or prospective public use.
The Council further finds that public convenience and neces-
sity require the reservation of easements enumerated in Streets and
Highways Code Section 8330 for all public facilities across, above
and under the described easement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Gilroy that the described strip of land be vacated, but that perma-
nent easements for all public facilities enumerated in Streets and
RESOLUTION NO. 81 - 32

Highways code Section 8330 across, above and under the described
strip of land be reserved to the City as shown upon the map attached
hereto.
