RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DISAPPROVING ON APPEAL RESOLUTION NOo 81-17 OF THE
PLANNING COMMISSION GRANTING A VARIANCE FOR PARKING
AT THE NORTHWEST CORNER OF CHURCH AND FIRST STREETSo
WHEREAS, an appeal in due form has been filed from
Resolution Noo 81-17 of the Planning Commission of the City of
Gilroy granting to GURRIES ENTERPRISES a variance for parking
requirements at the shopping center at the northwest corner of
Church and First Streets, in the City of Gilroy, and notice of
the hearing of said appeal has been given in the manner required
by law and the Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held
on April 6, 1981, at 8:00 porn. in the Council Chambers in the City
Hall at 7351 Rosanna Street, Gilroy, California, and evidence was
submitted upon the said application and the appeal from the find-
ings of the Planning Commission, the City Council finds:
(1) Some of the present parking stalls, particularly
along Church Street and in front of the market, are inadequate 0
(2) The variance is being requested because the site
is being overdeveloped 0
(3) The proposed use will adversely affect other pro-
perty in the vicinity or cause damage, hazard or nuisance to
persons or property; and
WHEREAS, the Planning Commission erred in granting the
variance, the variance shall be and the same is hereby denied.
PASSED AND ADOPTED this 6th day of April, 1981, by the
following vote:
