Resolution 1981-70 - ~ 1'- , . . '" r RESOLUTION NO. 81-70 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING A POLICY OF NON-DISCRIMINATION ON THE BASIS OF MARITAL STATUS. WHEREAS, after study, the Personnel Commission and staff has prepared and recommended adoption of a marital status policy for the City of Gilroy, and good cause appearing therefor, NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy approves the following policy guidelines and adopts the same to apply in the City of Gilroy: MARITAL STATUS POLICY It is the policy of the City of Gilroy not to discriminate in its employment and personnel actions with respect to its employees, prospective employees and applicants on the basis of Marital Status. No employee, prospective employee, or applicant shall be improperly denied employment or benefits of employment on the basis of his or her marital status. This policy applies to the selection of persons for a training program leading to employment in addition to the above-designated persons. Marital status is defined as an individual's state of marriage, non-marriage, divorce or dissolution, separation, widowhood, annulment. or other marital state for the purpose of this anti-discrimination policy. Spouse is defined as a partner in marriage as defined in California Civil Code Section 4100. Notwithstanding the above provisions, the City of Gilroy retains the right: 1. To refuse to place one spouse under the direct supervision of the other spouse where such has the potential for creating adverse impact on supervision, safety, security or morale. 2. To refuse to place both spouses in the same department, division, or facility where such has the potential for creating adverse impact on supervision, safety, security, or morale, or involves potential conflicts of interest. 3. To maintain or adopt bona fide health plans which provide additional or greater benefits to employees with dependents than to those employees without or with fewer dependents.
