RESOLUTION NO. 81-98 A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ESTABLISHING AN OVERLAY DRAINAGE ZONE ENCOMPASSING STORM DRAIN AREA "B" FOR FINANCING AN INTERIM DRAINAGE PROJECT. WHEREAS, a report of the Director of Public Works recommends an overlay zone providing for additional unit charges for all development in Storm Drain Area "B" so as to recover the cost of construction of an interim drainage project in that area and so as provide reimbursement to those developers now providing the funds to build the interim drainage project. THE COUNCIL OF THE CITY OF GILROY DOES HEREBY RESOLVE: (a) An overlay drainage zone is hereby established in Storm Drain Area "B" to assist in the financing of an interim drainage project designed to accommodate 1.000 residential units for that area. (b) All environmental report, administration. design, construction and other costs for the proposed project will be paid by the several developers who wish to build in Storm Drain Area liB", with all funding to be provided initially by agreement among those who now wish to build, hereafter called "Current Developers". (c) If the project proceeds to completion, the total sum of all costs therefore shall be divided by the 1.000 units to be served to determine the per unit charge required to finance the project, and this per unit drainage charge shall be assessed in addition to the development fees charged in Resolution No. 81-76 and collected by the City against all construction in Storm Drain Area "B" on the -1- RESOLUTION NO. 81-98 t !! . . following basis: One drainage unit charge per detached single family residence. Six-tenths drainage unit charge per single story multiple residence dwelling unit. Thirty-three hundredths drainage unit charge per multi-story multiple residence dwelling unit. Seven drainage unit charges per acre of commercial development. (d) The City shall reimburse the current Developers who provided project funding from the drainage unit charges collected. When 1,000 drainage unit charges have been collected and paid over, the Current Developers will have recovered all funds advanced, the interim drainage project will be at capacity, and the overlay zone and unit charges will be terminated. At that time, no further development in Storm Drain Area liB" will be permitted unless or until the drainage is further improved by the federal 566 or other project. (e) Current Developers shall include only those who contribute their pro-rata shares of the proposed project financing within 30 days of the award of the contract. All other later developers shall pay their per unit charges plus a ten percent surcharge, or their per unit charges as increased by indexing to the Engineer's News Record Cost of Construction Index, whichever is greater. (f) No further building permits will be issued to any developer in Storm Drain Area "B" until full payment of the above charges, and until the interim drainage project is functional. -2- RESOLUTION NO. 81-98 .!' . .
