Resolution 1982- 33 . ~ . . ~ RESOLUTION NO. 82-33 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY CERTIFYING AN ENVIRONMENTAL IMPACT REPORT FOR THE GENERAL PLAN REVISIONS FOR THE CITY WHEREAS, Terra-Sol Ltd. has prepared an Environmental Impact Report for the General Plan revisions for the City of Gilroy, and WHEREAS, after study and hearings the Council finds the Environmental Impact Report complete, and WHEREAS, the mitigation measures set forth hereafter should be approved as reducing significant effects to an acceptable level, NOW, THEREFORE, BE IT RESOLVED that the City Council certifies as complete the Environmental Impact Report on the General Plan revisions prepared by Terra-Sol Ltd. In addition, the Council identifies the following mitigating measures to mitigate the potentially significant impacts listed in the Environmental Impact Report: GENERAL PLAN REVISION: 1. An engineering study for the Tenth Street area shall be undertaken to determine the depth of flooding and then condition all new construction in this area such that structural damage or damage to contents of buildings in that area is prevented. 2. A detailed traffic analysis shall be undertaken to determine the traffic levels on First Street and Tenth Street and the degree to which traffic volumes will increase due to increases in intensity of commercial land uses. NOB HILL FOODS, INC.: 1. The developer shall be required to complete an engineering study specifically addressing flooding potential on the site and identify specific mitigation measures which will prevent damage to structures which may be constructed thereon and which would not result in increased flooding further downstream. 2. All building pads shall be raised at least one foot above the lOO-year flood elevation. RESOLUTION NO. 82-33 ~ - - - . . 3. Exterior lighting shall not be directed at the South Valley Freeway. 4. Facilities encouraging bicycle use shall be provided. 5. The developer shall provide programs and facilities which encourage the use of high occupancy vehicles. 6. Street improvements shall be provided by the developer subject to the approval of the City Engineer. 7. The developer shall provide for an archaeological reconnaissance of the site prior to the issuance of any building permits. 8. No construction shall take place within 100 feet of the adjacent highway. WOODWORTH PROPERTY: 1. All building pads shall be raised at least one foot above the lOO-year flood elevation. 2. Street improvements shall be provided by the developer subject to the approval of the City Engineer. BE IT FURTHER RESOLVED that the Council finds that any significant effects which are not capable of mitigation are out- weighed by the beneficial effects of the revisions in terms of providing for the orderly growth of the community.
