RESOLUTION NO. 82-39
RESOLUTION OF THE COUNCIL OF THE CITY OF
GILROY ALLOCATING INSTALLATION COSTS OF
UNDERGROUND CABLE TV IN NEW SUBDIVISIONS
WHEREAS, Section 21. 35 (5) of the Gilroy City Code
and prior Resolution No. 1603 provide that, among the improve~
ments to be installed underground by each subdivider, are
Cable TV services to each lot; and
WHEREAS, a question has arisen as to the distribution
of costs of the installation of such services;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Gilroy as follows:
1. To facilitate installation of Cable TV service
at minimum cost, subdividers shall provide a cable TV con-
duit in the utility trench at the same time that other basic
utilities are installed.
2. The required trench, conduit and substructures shall
be provided at subdividers cost.
3. The subdivider shall advance to the Cable TV company
a sum equal to the actual cost of labor and materials for the
installation of required cable, hardware and related equipment.
The amount so paid, without deduction or offset, shall be repaid
to subdivider by the Cable TV company on a pro-rata basis as
building construction is completed on each lot of the subdivision.
