RESOLUTION NO. 82-46
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
CERTIFYING THE ENVIRONMENTAL IMPACT REPORT FOR
A 14 LOT INDUSTRIAL SUBDIVISION ON 20 ACRES ON
THE EAST SIDE OF THE SOUTH VALLEY FREEWAY,
IMMEDIATELY SOUTH OF LUCHESSA AVENUE AT OBATA WAY
AND MAYOCK ROAD.
WHEREAS, Anthony Colucci and Associates has prepared
an Environmental Impact Report for a 14 Lot Industrial
Subdivision on 20 Acres on the East side of the South Valley
Freeway~. and
WHEREAS, after study and hearings the Council finds the
Environmental Impact Report complete, and
WHEREAS the mitigation measures set forth hereafter should
be approved as reducing significant effects to an acceptable
level,
NOW, THEREFORE, BE IT RESOLVED that the City Council
certifies as complete the Environmental Impact Report on the
project, prepared by Anthony Colucci and Associates. In
addition, the Council identifies the following mitigating
measures to mitigate the potentially significant impacts listed
in the Environmental Impact Report:
1. The build-out schedule of the project must be phased in
accordance with the availability of capacity of the sewage
treatment plant and other City services as determined by
the City Council.
2. The developer must contribute to signalization and street
improvements at the Monterey Road and Luchessa Avenue
intersection, as deemed necessary by traffic analysis,
subject to the approval of the City Engineer.
3. The design of all on-site storm drainage shall be subject to
the approval of the City Engineer.
4. Street improvements shall be provided by the developer subject
to the approval of the City Engineer.

5. All building pads shall be raised at least one foot
above the lOO-year flood elevation.
6. If any archaeological artifacts are discovered during
construction. all construction within 35' of the find
shall cease until the extent and significance of the
find can be determined by an archaeologist paid for by
the developer.
