RESOLUTION NO. 82-95

A RESOLUTION OF THE COUNCIL OF THE CITY
OF GILROY ADJUSTING FEES FOR THE DEVELOPMENT
OF RESIDENTIAL PRO~ERTY IN ACCORDANCE WITH
THE CONSTRUCTION COST INDEX
WHEREAS, a report of the Director of Public
Works demonstrates that based on the construction cost
index, current Development Fees are inadequate to fund
capital outlay for the development of residential
property and should be increased as set forth below:
THE COUNCIL OF THE CITY OF GILROY DOES HEREBY
RESOLVE that the Development Fees set forth in prior
Resolutions shall be amended to read as follows:

SECTION 9: RECREATION FEE:
The recreation fee for the Capital Outlay Recreation Fund
shall be $485. for the first bedroom plus $121 for each
additional bedroom per dwelling unit, except that the fee for
mobile homes shall be $303. per space.

(b) PUBLIC LIABILITY IN?URANCE AND PROPERTY DAMAGE INSURANCE:
The second paragr~ph s?a1~ be amended to read as follows:
Said public liability insurance and property damage
insurance shall be maintained by the Contractor in full
force and effect during the entire period of performance of
the contract. Said public liability insurance shall be in
the amount of One Million Dollars ($1,000,000) per occurrence
combined single limit coverage. Such coverage shall include

but shall not be limited to, protection against claims
arising from bodily and personal injury, including death
resulting therefrom, and damage to property resulting
from activities contemplated under this Contract, use
of owned and non-owned automobiles, products and completed
operations. Such insuranee shall be with insurers and
under forms of policies satisfactory in all respects
to the City and shall provide that notice must be given
to City at least forty-five (45) days prior to cancellation
or material change.
