Resolution 1982-103 , .. . . ,"' RESOLUTION NO. 82-103 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING AN INTERIM POLICY REGULATING THE INSTALLA- TION OF MOBILE HOMES ON RESIDENTIAL LOTS WHEREAS the Director of, Planning and the Chief Building Inspector have recommended adoption of an interim policy regulating the installation of mobile homes on residential lots in the City of Gilroy, and good cause appearing therefor, NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy approves the following policy guidelines and procedures as interim mobile home and house trailer installation regulations and adopts the same to apply in the City of Gilroy until revision of the Zoning Ordinance: MOBILEHOME INSTALLATION POLICY Permitted Locations of Mobilehomes The installation of mobilehomes is a principal permitted use in any residential district established by the Zoning Ordinance. Eligibility A mobilehome installation shall not be eligible unless it: a) was certified under the National Mobilehome Construction and Safety Standards Act of 1974, and b) has not been altered in violation of applicable codes; and c) be occupied only for residential use; and d) be attached to a permanent foundation system in compliance with all applicable building regulations; and e) have a minimum width of 20 feet; and f) be covered with an exterior material customarily used on conventional dwellings, approved by the Architectural and Site Committee and shall extend to the ground, except that when a solid concrete or masonry perimeter foundation is used, the exterior covering need not extend below the top of the foundation; and g) have a roof consisting of materials customarily used for conventional dwellings in the neighborhood as approved by the Architectural and Site Committee and to be installed in accordance with the Uniform Building Code; and h) have porches and eves, or roofs with eves when the Architectural and Site Committee conditions that it is necessary to make it compatible with dwellings in the area. RESOLUTION NO. 82-103 . . On Site Parking Parking Requirements, per Section 53 of the City of Gilroy Zoning Ordinance, under residential district shall be complied with. Building Permit After issuance of an Administrative Review Permit, a Building Permit Application shall be processed and a permit issued prior to installation of the mobilehome. A Building Permit shall be issued provided: a) there is compliance with all conditions of the Administrative Review Permit; and b) a Grading Permit is obtained where required; and c) there is compliance with all requirements of Section 18551 of the Health and Safety Code; and d) tbe development and site fees, and where applicable the school impact fees have been paid. Installation Requirements (A) a mobilehome shall be installed on a foundation system in accordance with installation instructions provided by: (1) the manufacturer of the mobilehome; or (2) a California licensed architect or engineer or registered building designer for an individual mobilehome where manufacturer's installation instructions are not available. (B) Both the foundation system and connection of the mobilehome to the foundation system shall be capable of withstanding the design loads and concentrated loads identified in the installation instructions. (C) The mobilehome electrical, gas, water and drain connections shall be made permanent in a manner applicable to permanent buildings. Gas shut off valves, meters and regulators shall not be located beneath the mobilehome. Occupancy Requirements Prior to occupancy, the mobilehome owner shall request from the City Building Official that a Certificate of Occupancy be issued pursuant to Section 18551 of the Health and Safety Code. Thereafter, for an existing mobilehome, any vehicle license plate, Certificate of Ownership and Certificate of Registration issued by a State agency is to be surrendered to the appropriate State agencies.
