RESOLUTION NO. 82-ll4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
GRANTING A WAIVER OF CANCELLATION FEES ON A WILLIAMSON
ACT CONTRACT LOCATED IN THE CITY OF GILROY
WHEREAS, application has been made by ROBERT T. RAJEWSKI
on property formerly owned by GLENN AND MURIEL BREM, to the
City for a waiver of fees for cancellation of Williamson Act
contract #70.058 on Assessor's Parcel No. 841-67-003 in the
sum of $97,684.00 and on Assessor's Parcel No. 841-67-007
in the sum of $103,804.00, and
WHEREAS, the City Council has considered cancellation
of said Williamson Act Contract #70.058 on said property located
east of the South Valley Freeway, south of Highway 152, and
shown on Exhibit A attached hereto, and
WHEREAS, a staff report was presented and all persons
desiring to speak on the waiver of Williamson Act Contract
Cancellation fees were heard, and after considering all the
evidence presented, the City Council made certain findings
and reached a decision on waiver of the Williamson Act
Cancellation fees as hereinafter set forth;
HOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Gilroy as follows:
1. The above recitals are true and correct.
2. That the city makes the following findings of fact:
(a) It is in the public interest to waive payment
of the cancellation fee, since on this basis,
the City was granted a ten (10) foot under-
ground sewer pipeline easement through the
subject property at no cost.
(b) While not invo1uptary, the transfer was made
in reliance on the City waiver of cancellation
fees.
(c) It is in the best interests of the program to
conserve agricultural land use that the payment
be waived so as to concentrate development
in the area now served by City services and
next to developed land, thus preventing urban
sprawl onto adjacent agricultural land.

3. That in view of the findings heretofore made and
considering the applicable law, the request for a waiver
of cancellation fees on Williamson Act Contract #70.058 is
hereby APPROVED by the City Council. A certified copy of
this resolution shall be forwarded to the Secretary of the
Resources Agency for his approval.
