RESOLUTION NO. 83-15
A RESOLUTION APPOINTING TIME AND PLACE OF HEARING
PROTESTS IN RELATION TO PROPOSED ACQUISITIONS
AND IMPROVEMENTS AND DIRECTING NOTICE
EAST NINTH STREET ET AL. ASSESSMENT DISTRICT 83-1
RESOLVED, by the City Council of the City of Gilroy, California,
that
WHEREAS, pursuant to Resolution No. 80-71 of Preliminary
Determination and of Intention adopted on August 4, 1980, as amended,
pursuant to the Gilroy City Code, the Engineer of Work of said City has
filed with the City Clerk of this City the written report called for
under said Code and by said Resolution of Preliminary Determination and
of Intention, as amended, which report has been presented by said Clerk
to this Council for consideration, and this Council has considered and
preliminarily approved said report and ordered that the same stand as
the report for the purposes of all subsequent proceedings had pursuant
to said Resolution of Preliminary Determination and of Intention, as
amended;
NOW, THEREFORE, IT IS ORDERED, that Monday, the 4th day of
April, 1983, at the hour of 8:00 o'clock p.m. in the regular meeting
place of said Council, Council Chambers, City Hall, 7351 Rosanna
Street, Gilroy, California, be, and the same are hereby, appointed and
fixed as the time and place when and where the Council will consider
and finally determine whether the public interest, convenience and
necessity require said acquisitions and improvements and when and where
it will consider and finally act upon the Engineer's Report under said
Resolution of Preliminary Determination and of Intention, as amended.
IT IS FURTHER ORDERED, that the City Clerk of this City be, and
she is hereby, directed to give notice of said hearing once a week for
two weeks in the Gilroy-Morgan Hill Dispatch, a newspaper published and
circulated in said City, and by conspicuously posting a notice thereof
headed "Notice of Improvement" in letters of not less than one-half inch

in height on a bulletin board in or adjacent to the City Hall and along
all the open streets within the assessment district at not more than
three hundred feet apart and not less than three in all, said posting
and first publication to be had and completed at least ten (10) days
before the date herein set for hearing of protests.
IT IS FURTHER ORDERED, that said notices to be published and
posted shall, in legible characters, state the fact and date of the
passage of the Resolution of Preliminary Determination and of Intention,
as amended, and of the filing of said report and of the date, hour and
place set for the hearing of said protests, briefly describe the
acquisitions and improvements proposed to be made, refer to said
Resolution of Preliminary Determination and of Intention, as amended,
and report for further particulars and contain the name and telephone
number of a local department or agency designated by the City Council
to answer inquiries regarding the protest proceedings.
IT IS FURTHER ORDERED, that the City Clerk of said City shall
mail, or cause to be mailed, notice of adoption of said Resolution of
Preliminary Determination and of Intention, as amended, and the filing
of said report, postage prepaid, at least ten (10) days before the date
set for h€aring of said protests, to all persons owning real property
to be assessed, whose names and addresses appear on the last equalized
assessment roll prior thereto or as known to the City Clerk, which
notice shall contain a statement of the time, place and purpose of the
hearing on said Resolution of Preliminary Determination and of
Intention, as amended, report and a statement of the total estimated
cost of the proposed acquisitions and improvements, the total amount as
shown by said report to be assessed against the particular parcel
covered by the notice, together with a statement that any person
interested may file a protest, in writing, as provided in said Code and
report for further particulars and contain the name and telephone
number of a local department or agency designated by the City Council
to answer inquiries regarding the protest proceedings.
