Resolution 1983-63 " . . RESOLUTION NO. 83 - 63 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY RELATED TO THE USE OF 4R INTERSTATE FUNDS. WHEREAS, State Route 17, the Nimitz Freeway, is a vital element of the transportation system on the easterly side of the San Francisco Bay; and WHEREAS, said freeway serves as the major freeway access for the delivery of goods to and from the U.S. Coast Guard Facility on Govern- ment Island, U.S. Naval Air Station at Alameda, the Naval Supply Center- Alameda Facility and Naval Supply Center-Oakland Facility, the Oakland Army Base and the Port of Oakland; and WHEREAS, access to the above named facilities is vital to the national defense; and WHEREAS, the Board of Supervisors of the County of Alameda by Resolution No. 195622 recommended that the Nimitz Freeway be included in the Federal-Aid Interstate Syste; and WHEREAS, that portion of State Route 17 from Route FAI-80 near the San Francisco Bay Bridge to Route FAI-280 in San Jose has been in- cluded in the Interstate System as "non-chargeable mi1eage'~ under Sec- tion 139(a) Title 23, U.S. Code; and WHEREAS, State Route 17 is in serious need of resurfacing, re- storation, rehabilitation, and reconstruction; and WHEREAS, present law prohibits the use of Interstate Rehabilita- tion (IR) Funds for resurfacing, restoration, rehabilitation or recon- struction of sections of the Interstate System classified as "non- chargeable mileage"; and WHEREAS, California has 92.7 miles of "non-chargeable mileage"; and \.-lHEREAS, there are 514 miles of "non-chargeable mileage" in the Interstate System in states which would benefit from being eligible RESOLUTION NO. 83 - 63 -1- ~ -' . . for the use of IR Funds. NOW, THEREFORE BE IT RESOL\~D that the City Council of the City of Gilroy does and it hereby requests the Congress of the United States to adopt legislation to allow for the use of IR Funds on "non-chargeable mileage" routes as designated in Section 139(a), Title 23, U.S. Code; and BE IT FURTHER RESOLVED that this Council of the City of Gilroy does and it hereby requests that the legislators representing California introduce and support legislation to qualify the "non-chargeable mileage" on the Interstate System for use of IR Funds; and BE IT FURTHER RESOLVED that this Council does and it hereby re- quests the California Legislature, the California Department of Trans- portation, the County of Santa Clara, the Metropolitan Transportation Commission, and the Cities in Alameda and Santa Clara Counties to en- courage and support efforts and to take such action as may be necessary to achieve legislation whereby the Interstate Highway mileage designated under Section 139(a), Title 23, U.S. Code will qualify for IR Funds; and BE IT FURTHER RESOLVED that this Council does and it hereby directs the City Clerk to fO~7ard copies of this Resolution to the State Assemblymen and Senators representing Alameda and Santa Clara Counties, to the California Congressional Contingent in Washington, D.C., to the County of Santa Clara, to Ca1trans, to lITC, to the Cities in Alameda and Santa Clara Counties and to all other agencies as may be interested.
