RESOLUTION NO. 84-9 B
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY GRANTING A CERTIFICATE OF CANCELLATION
OF A WILLIAMSON ACT CONTRACT LOCATED IN THE CITY
OF GILROY
WHEREAS, the City Council did adopt Resolution No.
82-126 on the 20th day of December, 1982, with the intent to
cancel the Williamson Act Contracts #68-127 and #71-034 on
62.21 acres, more or less, of land north of Hecker Pass Highway,
between Burchell Road and Morey Avenue, and
WHEREAS, for convenience, the cancellations for both
applicants were included on one resolution, and
WHEREAS, the intent of City Council was to issue a
separate cancellation for each applicant, and
WHEREAS, the City Council desires to clarify such
intent to allow the cancellation fee required of each applicant
to be paid independently of the other, and
WHEREAS, the amounts of such fees are the same as set
forth previously in the Certificate of Tentative Cancellation,
being $33,941.00 for ED HOEY, and
WHEREAS, it is the intent of City Council to clarify
the former cancellation, not issue a new cancellation;
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Gilroy, to allow ED HOEY, upon payment of
$33,941.00, to cancel Williamson Act Contractscovering A.P.N.
783-04-001, 009, 012, 013 and 014.
PASSED AND ADOPTED this 31st day of January, 1984,
by the following vote:
