RESOLUTION NO. 84-25 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY FIXING INTERIM STREET IMPROVEMENT FEES AND CHARGES FOR IMPROVEMENT OF SANTA TERESA BOULEVARD IN THE NORTHWEST QUADRANT OF THE CITY WHEREAS, the present policy for requiring improvement is not equitable and there should be a more equitable method of paying for arterials by the developers of the Northwest Quadrant of the City; and WHEREAS. an interim method of funding for Santa Teresa Boulevard should be adopted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy that: 1. At the time a subdivision map is finalled, each developer, with a project adjacent to Santa Teresa Boulevard, will sign a deferred development agreement requiring the full improvement, including pavement. curbing, landscaping, undergrounding electrical lines, and signalization, of Santa Teresa Boulevard whenever the City requests such improvement. This deferred development agreement will be similar to those presently utilized by the City in every regard except that the responsibility for the deferred development agreement will remain with the undeveloped, raw land portion of each development, rathp.r than be a liability upon the individua1. homeowners who may purchase a home in one of these tracts. 2. When a building permit is issued for a building in any project adjacent to Santa Teresa Boulevard, the City will collect a street improvement fee from the developer. This fee will be based upon the cost of improvements for Santa Teresa Boulevard as follows: , , . The estimated cost set forth above shall be charged to the developer based upon the total build-out for all approved projects abutting Santa Teresa Boulevard. This method will charge all developers an equal fee per dwelling unit. Staff will diligently pursue a comprehensive street improvement funding policy to be presented to the City Council May 1, 1985. If the comprehensive street improvement funding policy is adopted by the City Council, then the City will reimburse to each developer any excess fees collected under this interim program. If the future fee is more than the interim fee, the developers would not be liable for any additional payments for permits issued prior to establishing such fee. In either case. all developers would pay the full amount of any new fee after its adoption. 5. If the City Council fails to adopt a comprehensive street improvement funding policy and fee, then the City will either a) retain the funds deposited by any developer for future improve- ment of Santa Teresa Boulevard. or b) require improvement of Santa Teresa Boulevard according to the deferred development agreement, while crediting each such developer for funds they previously deposited for Santa Teresa Boulevard improvements.
