RESOLUTION NO. 84-45
A RESOLUTION, AFTER PUBLIC HEARING, OF THE
CITY OF GILROY WITH REGARD TO A REORGANIZATION
PURSUANT TO THE DISTRICT REORGANIZATION ACT OF
1965 DESIGNATED AS "MOREY AVENUE REORGANIZA-
TION 84-1"
BE IT RESOLVED AND FOUND BY THE CITY COUNCIL OF
THE CITY OF GILROY, AS FOLLOWS:
1. That the City of Gilroy is the conducting
agency for proceedings to reorganize the territory described
in Exhibit "A" attached hereto and incorporated herein and
designated as "MOREY AVENUE REORGANIZATION 84-111.
2. That the territory which the petitioners
request be annexed to the City of Gilroy, and which the City
Council proposes to annex and to detach from the South Santa
Clara County Fire District, is contiguous to the city limits
of the City, contained less than 12 registered voters at the
time the petition was filed, is uninhabited territory.
3. That said petition does not contain the written
consent of all of the land owners to the annexation.
4. That the Council has previously approved a
Negative Declaration and mitigation measures for the proposed
annexation and reorganization as proposed.
5. That the City Council, as conducting agency, has
also duly performed the following:
a. The Council has initiated and completed
reorganization proceedings.
b. The territory described in Exhibit "A:
hereto is ordered reorganized and is
organized to include the following changes
of organization.

i. Annexation to the City of Gilroy
ii. Detachment from the South Santa
Clara County Fire District.
c. The City of Gilroy, as conducting agency,
reorganized such territory as indicated
above after a duly noticed public hearing
this date, and without election, it being
found and concurred in that the territory
described in Exhibit "All is uninhabited,
and no written protests to the reorganization
of the described territory were filed prior
to the public hearing.
6. That the herein described reorganization and each
of the actions of the City of Gilroy herein described were in
full accordance with the District Reorganization Act of 1965,
and Government Code Section 56320 which is part thereof.
PASSED AND ADOPTED this 4th day of June, 1984,
by the following vote:

LEGAL DESCRIPTION
MOREY AVENUE REORGANIZATION 84-1
BEING a portion of lot 35 as shown on that certain map entitled
"Map of Henry Miller's Subdivision of Las Animas Rancho Lot No. 23"s
recorded in Book "H" of maps at page 5, Santa Clara County Records.
BEGINNING at the southwest corner of said Lot 35, being in the
Gilroy City limits established by "Kern Ave. 81-9" annexation and
"?1orey Ave. fJ1 71-7" annexation; thence along the southerly line
thereof, South 890 04' 05" East 1053.69 feet, in the Gilroy City
limits established by: Morey-Mantelli 83-2" annexation; thence along
the Easterly line of Parcel B as shown on th~t Record of Survey
recorded in Book 437 of maps at pages 13-16, 'Santa Clara County
Records, North 40 55' 54" 397.05 feet to the Northerly line of said
Lot 35; thence leaving the City limits, South 890 09' 38" East
1026.29 feet to the Northeasterly corner of said Lot 35 in the
city limits as established by "Kern Ave. 81-9" annexation first
mentioned; thence South 000 58' 30" Hest 397.74 feet to the Point
of Beginning, containing therein 9.460 acres.

hereby certify that the attached Resolution No. 84-45 is an
original resolution, duly adopted by the Council of the City of
Gilroy at a regular meeting of said Council held on the 4th
day of June , 19~, at which meeting a quorum was
present.
