RESOLUTION NO. 84-60 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY APPROVING A TENTATIVE MAP FOR 122 RESIDENTIAL LOTS ON THIRTY-SIX ACRES MORE OR LESS ON THE EAST SIDE OF SANTA TERESA BOULEVARD, SOUTH OF FIRST STREET WHEREAS, application TM 84-1 has been made by ASPERIO'BENASSI to the Planning Commission for approval of a tentative map for l22 residential lots on thirty-six acres more or less on the east side of Santa Teresa Boulevard, south of First Street, and WHEREAS, after a public hearing the Planning Commission has passed Resolution No. 84-39 in which it recommends approval of a tentative map for 92 lots subject to twenty-one conditions, and HHEREAS. the Council has approved a Negative Declaration under the California Environmental Quality Act and has held a public hearing on the application and has considered the Planning Commission recommendation and the evidence presented; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy that: l. The Negative Declaration is approved including five mitigation measures applied to reduce significant adverse affects on the environment. 2. The tentative map for 122 lots is approved subject to the following twenty-four conditions: 1. Street alignments connecting to adjoining develop- ments shall be coordinated with and approved by the Director of Public Works. 2. Street improvements and the design of all storm drainage. sewer lines. and all street sections and widths shall be subject to the approval by the Director of Public Works. 3. At the time of submittal for any building permits, the developer shall pay school impaction fees and/or contribute to the cost of providing a new elementary school in or near the project area. RESOLUTION NO. 84-60 ~ . . 4. Existing mature specimen trees and shrubs native to the area shall be preserved wherever possible. 5. Grading operations and soil compaction activities shall meet the approval of the Director of Public Works. 6. All utilities to the site and adjacent to the larger project area along Hecker Pass Highway shall be installed underground. at the time of development of that area. 7. An all-weather road surface shall be provided to the lots prior to construction. subject to the approval of the Director of Public Works and the Fire Department. 8. Adequate turn around space shall be provided for any cul-de-sac to meet the City of Gilroy's Fire Department standards and approval. 9. Fire access, hydrant locations, and water main sizing shall be approved by the Gilroy Fire Department prior to the issuance of any building permits. 10. Any existing water wells shall be sealed to meet the approval of the Director of Public Works and the Santa Clara Valley Water District (SCVWD). 11. The developer shalt negotiate rights-of-way with Pacific Gas & Electric Company and other utilities. 12. Residential unit construction shall be phased in accordance with the approved build-out assignment for the project site, 13. The developer shall provide adequate dual access for each phase of development to meet the approval of the Directors of Public Works and Planning. and the Fire Chief. 14. All building pads shall be raised at least one foot above the 100-year flood elevation. l5. Additional turning lanes and channelization will be required at the intersection of Uvas Park Drive and Santa Teresa Boulevard subject to the approval of the Director of Public Works. 16. The proposed access from Third Street to Santa Teresa Boulevard shall conform to the County's access policy and have the approval of the Director of Public Works, City of Gilroy. 17. All single family residential lots shall have a minimum size of 6000 square feet, as required by the City's Zoning Ordinance. RESOLUTION NO. 84-60 -2- '''-".."..''"...,,'''';~''"''''... ,,' . . . 18. The developer shall improve Uvas Park Drive from Laurel Drive to Santa Teresa Boulevard, subject to the approval of the Directors of Public Works and Planning. 19. The developer shall dedicate the Uvas Park Drive right-of-way and public facility zoned land, to bhe City of Gilroy, subject to the approval of the Director of Public Works. 20. A permanent access drive for the condominiums shall be provided to Sequoia Drive. 2l. This tentative map is approved subject to the City's ability, subsequent to November 6, 1984, to finance capital improvements and maintenance of such improve- ments to service this project. These improvements shall include a) police and fire facilities, b) streets. c) storm drainage piping and channels, and d) water supply and sewage system facilities. 22. A Third Street access driveway shall be added in addition to the exit on the unnamed street along the western side of the project in the first phase. 23. All units immediately to the rear of homes fronting Laurel Drive shall be single story. 24. Third Street shall be connected to Santa Teresa Boulevard during the first phase of construction.
