RESOLUTION NO. 8q.- 64
RESOLUTION OF THE COUNCIL OF THE CITY OF
GILROY ORDERING SUMMARY VACATION OF A TEN
FOOT IRRIGATION EASEMENT ALONG THE SOUTH-
WESTERLY LINE OF NINTH STREET WEST OF
CHESTNUT STREET
WHEREAS, the Council of the City of Gilroy is
proceeding under Chapter 4 of the Public Streets. Highways and
Service Easements Vacation Law to vacate summarily a 10 foot
irrigation easement along the southwesterly line of Ninth
Street for a distance of 400 feet west of Chestnut Street,
as shown upon the map attached hereto; and
WHEREAS, no use has been made of said irrigation
easement for more than five years; and
WHEREAS the Director of Public Works reco~nends that
said easement be vacated, and the Council having duly
considered the evidence presented as to the vacation
described herein;
The Council does hereby find that the described 10
foot irrigation easement is unnecessary for present or
prospective public use. and has not been used for a period
in excess of five years.
NOW, THEREFORE, BE IT RESOLVED by the Council of
the City of Gilroy that the described 10 foot irrigation
easement be vacated.
