RESOLUTION NO. 85 - 3
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MAKIKG
FINDINGS REGARDING CHANGES AND HODIFICATIONS OF UNIFORH
FIRE CODE AND UNIFORM BUILDING CODE.
w~EREAS, the City Council has heretofore adopted the latest
edition of the Uniform Building Code, Uniform Mechanical Code,
National Electric Code, Uniform Plumbing Code, Uniform llousing Code
and the Uniform Fire Code pursuant to the authority set forth in
Section 17922 of the Health and Safety Code as the construction
codes for the City of Gilroy; and
~~EREAS, Section 17958.5 and 17958.7 of the Health and
Safety Code authorize the City to make changes or modifications in
such codes as deemed reasonably necessary because of local conditions,
upon express findings that such modifications or changes are needed;
and
WHEREAS, certain local conditions have justified and now justi-
fy modifications in such codes, by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Gilroy, State of California, that it hereby finds and determines
that the following designated changes or modifications are reasonably
necessary because of local conditions set forth hereafter:
1. The Uniform. Fire Code
The Uniform Fire Code is adopted because certain local
conditions in the City of Gilroy require the adoption of a Uniform
Fire Code to provide for adequate fire prevention and suppression
measures.
The City of Gilroy is subject to possible severe earth-
quake hazards. The City must maintain uniform standards with respect
to fire prevention in order to minimize the potential of severe fire
danger and damage caused by earthquakes. Portions of the City of

Gilroy are in hillside hazardous fire areas that have limited fire
suppression forces available. For the protection of life and property
in those areas, adoption and enforcement of a Uniform Fire Prevention
Code is necessary.
2. Amendments Impacting on Housing
The fire fighting capabilities of the City's fire suppres-
sion forces are limited. Generally, protection of multi-family dwel-
lings and other buildings over 30 feet in height, or that require a
fire flow of in excess of 1500 gallons per minute are beyond the capa-
bilities of the fire suppression services. Therefore, where multi-
family dwelling and other buildings are in excess of 30 feet in height,
or three stories in height, or require a fire flow greater than 1500
gallons per minute, it is necessary they have installed an automatic
fire sprinkler system to extinguish fires.
Furthermore, the City of Gilroy is subject to a high risk
of serious earthquakes. In multi-family and other buildings more
than 30 feet in height, or more than three stories in height, or re-
quiring a fire flow greater than 1500 gallons per minute, there exists
a greater risk of a serious fire resulting from earthquakes. Since
automatic fire sprinkler systems are installed with earthquake bracing
to protect against physical damage in the event of building movement,
the potential for a serious fire in these types of buildings is great-
ly reduced and, likewise, the total fire damage likely to result from
a severe earthquake is also reduced.
Finally, certain hazardous fire areas of the City due to a
combination of weather, vegetation and topography, necessitate the
requirement of fire resistive or special purpose roof coverings on new
buildings, including dwellings.
