RESOLUTION NO. 85-38
RESOLUTION OF THE COUNCIL OF THE CITY OF
GILROY APPROVING A TENTATIVE MAP FOR 33
RESIDENTIAL LOTS ON 4.7 ACRES, MORE OR
LESS, ON THE NORTH SIDE OF MANTELLI DRIVE
WEST OF WELBURN AVENUE
WHEREAS, application TM 85-1 has been made by
GILROY-MANHATTAN ASSOCIATES to the Planning Commission
for approval of a tentative map for 33 residential lots
on 4.7 acres, more or less, on the north side of Mantelli
Drive, west of Welburn Avenue, and
WHEREAS, after a public hearing the Planning
Commission has passed Resolution No. 85-13 in which it
recommends approval of a tentative map for 33 lots subject
to seventeen conditions, and
WHEREAS, the Council has approved a Negative Declaration
under the California Environmental Quality Act and has held
a public hearing on the application and has considered the
Planning Commission recommendation and the evidence presented;
NOW, THEREFORE, BE IT RESOLVED by the Council of
the City of Gilroy that:
1. The Negative Declaration is approved including
all mitigation measures applied to reduce significant adverse
affects on the environment.
2.
The tentative map for 33 lots is approved subject

to the following seventeen conditions:
1. Street alignments connecting to adjoining
developments shall be coordinated with
those projects and approved by the City
Engineer.

2. Street improvements and the design of
all storm drainage, sewer lines, and
~ll street sections and widths shall be
subject to the approval of the City
Engineer.
3. A 24' wide secondary access shall be
provided, prior to occupancy, which shall
meet the approval of the City Engineer and
Fire Department.
4. The developer shall provide an ownership
association for maintenance of the private
street, common areas, landscaped street
frontages, and parkways.
5. If at the time of submittal for any building
permits, the Gilroy Unified School District
and the City of Gilroy declare the schools
impacted, the developer shall pay school
impaction fees or contribute to the cost of
providing a new elementary school in or near
the project area.
6. Existing specimen trees and shrubs native to
the area shall be preserved wherever possible.
7. All utilities to the site are to be installed
underground.
8. An all-weather road surface shall be provided
to the lots prior to construction, subject
to the approval of the City Engineer and Fire
Department.
9. Grading operations and soil compaction
activities shall meet the approval of the
City Engineer.
10. Fire access, hydrant locations, and water main
sizing shall be approved by the City Fire
Department prior to issuance of any building
permits.
11. All existing water wells shall be sealed to
meet the approval of the City Engineer and
the Santa Clara Valley Water District.
12. The developers shall negotiate rights-of-way
with Pacific Gas and Electric Company and
other utilities.

13. l'rivate easements shall be provided
for the private street and on-street
parking.
14. Public utility easements shall be provided
for storm drain, sewer, and water lines.
15. Street names shall be subject to approval
by the City Public Works Department.
16. All future buildings shall be set back a
minimum of 25 feet from the fault line.
17. The developer shall contribute to the
Interim Street Improvement Fund for the
City's northwest quadrant, to include the
development of Santa Teresa Boulevard.
