RESOLUTION NO. 85-41 A RESOLUTION AFTER PUBLIC HEARING, OF THE CITY OF GILROY WITH REGARD TO A REORGANIZATION PURSUANT TO THE DISTRICT REORGANIZATION ACT OF 1965 DESIGNATED AS "MURRAY" AVENUE REORGANIZA- TION 84-2" BE IT RESOLVED AND FOUND BY THE CITY COUNCIL OF THE CITY OF GILROY, AS FOLLOWS: 1. That the City of Gilroy is the conducting agency for proceedings to reorganize the territory described in Exhibit "A" attached hereto and incorporated herein and designated as ''MURRAY AVENUE REORGANIZATION 84-2". 2. That the territory which the petitioners request be annexed to the City of Gilroy, and which the City Council proposes to annex and to detach from the South Santa Clara County Fire District, is contiguous to the city limits of the City, contained less than 12 registered voters at the time the petition was filed, is uninhabited territory. 3. That said petition does not contain the written consent of all of the land owners to the annexation. 4. That the Council has previously approved a Negative Declaration and mitigation measures for the proposed annexation and reorganization as proposed. 5. That the City Council, as conducting agency, has also duly performed the following: a. The council has initiated and completed reorganization proceedings. b. The territory described in Exhibit "A" hereto is ordered reorganized and is organized to include the follo~ng changes of organization. RESOLUTION NO. 85-41 -1- .1 . . .... EXHIBIT A .EVISED MURRAY AVENUE REORGANIZATION NO. 84-2 IN THE CITY OF GILROY 2/19/85 Beginning at the point of intersection of the westerly line of Murray Avenue (66 feet wide) with the corporate city limits of the City of Gilroy, California, as established by the "First Nothern Addition" to the City of Gilroy as described in the Ordinance 505, adopted November 20, 1952; thence running along ~~e corporate city limits line, S 670 40' W, 752.49 feet; thence N 220 20' W, 264.28 feet; thence S 670 40' W, 40.00 feet; thence N 220 20' W, 264.28 feet; thence S 670 37' W, 826.57 feet to the Southern Pacific Railroad Company property; thence along said Southern Pacific Railroad Company property, N 220 20' W, 2673.30 feet to the northerly right of way line of Las Animas Avenue (66.feet wide); thence along said northerly right of way, N 670 43' E, 1689.67 feet to the easterly right of way line of Murray Avenue; thence S 220 20' E, 66.00 feet to the point of intersection of the southerly right of way of Las Animas Avenue and the easterly right of way of Murray Avenue, said point being also the northerly corner of ~Murray Avenue Annexa- tion No. 80-2" as described in Resolution 80-76 adopted 4-18-80, City of Gilroy; ~~ence along the southerly right of way of Las Animas, being also the corporate city lL~it lime, S 670 43' W, 692.27 feet; thence along the corporate city limit line, S 220 20' E, 621.68 feet to the northerly boundary of the Santa Clara Valley Water District right of way; thence along the boundary of said Santa Clara Valley Water District right of way, along a curve to the right with a radius of 251.00 feet, through a central angle of 900 00' 00", an arc length of 201.47 feet; thence S 220 20' E, 310.37 feet; thence along a curve to the left with a radius of 99.00 feet; through a central angle of 900 00' 00", an arc length of 155.51 feet; thence N 670 40' E, 446.73 to the westerly line of said Murray Avenue; thence along said westerly line of Murray Avenue (being the existing corporate city limit line), S 220 20' E, 604.00 feet; thence along the corporate city limit line as established my "Murray Avenue Annexation 78-3", "Murray Avenue Annexation 76-7," and Murray i Avenue Annexation No.2, 72-3" the following courses and distances: S 670 40' W, 792.00 feet; S 220 20' E, 712.80 feet; I N 670 40' E, 40.00 feet; ) 220 20' 264.28 feet and 670 40 ' E, 752.00 fee t; thence along said S E, N westerly line of Murray Avenue, being the corporate city limit line as established by the "Burke Drive Annexation 69-1" adopted by Ordinance 852 of the City Council, S 220 20' E, 34].2 feet to the point of beginning, and containing 73.50 acres of land, morp. or less. The City of Gilroy, as conducting agency, reorganized such territory as indicated above after a duly noticed public hearing this date, and without election, it being found and concurred in that the territory described in Exhibit "A" is uninhabited, and no written protests to the reorganization of the described t~rritory were filed prior 6. That the herein described reorganization and each of the actions of the City of Gilroy herein described were in full accordance with the District Reorganization Act of 1965, and Government Code Section 56320 which is part thereof.
