RESOLUTION NO. 85- 52
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DECLARING PUBLIC NECESSITY FOR ACQUISITION OF A
SANITARY SEWER EASEMENT AND TEMPORARY CONSTRUCTION
EASEMENT OVER PROPERTY LOCATED ALONG KERN AVENUE,
GILROY, CALIFORNIA, BELONGING TO BRUCE ROWLISON
WHEREAS, Notice was given to BRUCE ROWLISON as
landowner pursuant to Code of Civil Procedure section l245.235
of a hearing to be held on August 19, 1985 to consider adoption
of a Resolution of Necessity for the acquisition of a permanent
easement for sanitary sewer purposes and a temporary
construction easement over subject property, and
WHEREAS, upon said hearing, BRUCE ROWLISON appeared
and was heard
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Gilroy, in accordance with the provisions of CCP
Sl245.230, as follows:
(a) A general statement of the public use for which the
property is to be taken is as follows:
project for extension of city sanitary sewer line between
Wren and Morey Avenues.
The statutes which authorizes the City of Gilroy to acquire the
property by Eminent Domain are:
California Government Code Section 37350.5; California Code
of Civil Procedure Section l240.l25.
(b) The City Council has found and determined that the
public interest and necessity requires the proposed project; the
proposed project is planned or located in a manner that will be
most compatible with the greatest public good and the least
private injury; the property hereafter described is necessary
for the proposed project.
(c) The offer required under Government Code S7267.2 has
been made.
(d) A description of the general location and the extent
of the property to be taken is as follows:
Attached as Exhibit "A" hereto.
