RESOLUTION NO. 85-58
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
ESTABLISHING AN INTERIM PAST DEBT SERVICE AND CEASE
AND DESIST COST SCHEDULE AMONG THE USERS OF THE
AGRICULTURAL SEWER SYSTEM.
After a noticed public hearing this date, and based upon
evidence received at the hearing and the July 22, 1985 report of
the City Administrator on the Agricultural Sewer System, and
good cause appearing therefore,
The City Council finds that on an interim basis, the cost of
past debt service and operation and maintenance associated with
cease and desist orders should be shared by the agricultural
industries according to their prior agreed schedule which will be
valid until a different cost sharing schedule can be worked out
among them,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GILROY, CALIFORNIA, that pursuant to the provisions of Gilroy
City Code section 19.28, the City Council does hereby establish
the following interim schedule for sharing among the users of the
Agricultural Sewer System, the cost of past debt service and
operation and maintenance to meet cease and desist orders on the
system installed by the city for their benefit:
Gilroy Foods
Gentry
Gil Can
Garden Valley Foods
27.4%
17.7%
35.3%
19.6%
BE IT FURTHER RESOLVED that this interim charge schedule shall
be reviewed by the Council in 60 days.
PASSED AND ADOPTED this 3rd day of September, 1985, by the
