"" '... ~ RESOLUTION NO. 85-91 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MODIFYING AND AFFIRMING ON APPEAL THE ACTION OF THE PLANNING COMMISSION GRANTING ARCHITECTURAL AND SITE APPROVAL FOR A BUILDING AT THE NORTH- WEST CORNER OF ROSSI LANE AND MAYOCK ROAD. WHEREAS, DEt MONTE DEVELOPERS, OBATA BROTHERS and WOOLWORTH CONSTRUCTION CO. have filed an appeal in due form from the action of the Planning Commission of the City of Gilroy granting architectural and site approval without conditions for the building of ROBERT MANN at the northwest corner of ROSSI LANE and MAYOCK ROAD, after appeal from staff and committee denial, and notice of the hearing of said appeal has been given in the manner required by law and the Zoning Ordinance of the City of GilroYi and WHEREAS, the said hearing on the appeal has been held on December 2, 1985 at 8:00 p.m. in the Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy; California, and continued to this date and evidence was submitted upon the said application and appeal from the findings of the Planning Commission, the City Council finds: (1) The findings of the Planning Commission are hereby disapproved in part as not complete; and (2) The Planning Commission did not err in granting tFle application, but should have imposed additional conditions recommended by staff. THEREFORE, BE IT RESOLVED that the action of the Planning Commission is hereby modified by adding the following conditions, and as modified, is affirmed: 1. The four standard conditions of architectural and site approval. RESOLUTION NO. 85-91 -1- ... ; ... ~ "'.. . . r- ." ~ 2. The southeast corner of the building will have a squared-off niche, instead of the proposed beveled corner, which will aid in the screening of air-conditioning equipment. 3. The proposed building will incorporate a 16" to 18" high fascia cap on all four sides projecting out from the main wall face. 4. A large decorative landscaped trellis structure will be incorporated at three separate locations along the building's street frontages. 5. Landscape treatment along street frontages will incorporate earth-berming in order to reduce the apparent building mass.
