RESOLUTION NO. 86-15
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DISAPPROVING A TENTATIVE MAP FOR A RESIDENTIAL
SUBDIVISION OF 169 LOTS ON THE WEST SIDE OF
SANTA TERESA BOULEVARD, BETWEEN MANTELLI DRIVE
AND DAY ROAD.
WHEREAS~ application TM 85-7 has been made by
RAND SCHAAL, LONGMEADOW PARTNERSHIP to the Planning
Commission for approval of a tentative map for a residential
subdivision of 169 lots on the west side of Santa Teresa
Boulevard, between Mante11i Drive and Day Road.
WHEREAS, after a public hearing the Planning Commission
has noted a previously approved Environmental Impact Report
under the California Environmental Quality Act and has
passed Resolution No. 86-10 in which it recommends disapproval
of the tentative map for five reasons as recommended by staff;
and
WHEREAS, the Council has held a public hearing on the
application and has considered the Planning Commission recommen-
dation and the evidence presented;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
GILROY DOES RESOLVE AS FOLLOWS:
That the tentative map is disapproved for the following
reasons, but without prejudice~
1. The proposed subdivision does not have at this
time secondary access to serve the 169 units
proposed. Section 21.l0(d) of the City Code
limits the number of single family dwellings
without secondary access to eighteen (18) units.
2. The City has no record of a dedicated right-of-way
on the alignment of Calle Del Rey as stated on the
Tentative Map. Approval of this map without secured
right-of-way would put the City in the position of
condemning the necessary right-of-way to construct secondary
access for the project.

3. Street alignments as shown on the applicant's
map do not meet the minimum design requirements
in the City Standards.
4. This project does not have a sewer agreement with
the City. It is unknown if and when adequate
sewer allocation will be made available for
the project.
5. If approved, recent changes in the State Subdivision
Map Act could extend the time limit of this map
indefinitely with the City having no ability
to modify the map.
