RESOLUTION NO. 86-17
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DECLARING SCHOOLS OF THE GILROY UNIFIED SCHOOL
DISTRICT TO BE IMPACTED AND DETERMINING FEES TO BE
PAID.
WHEREAS, an application has heretofore been filed
by the GILROY UNIFIED SCHOOL DISTRICT requesting a declaration
of impaction under the provisions of Gilroy Ordinance No.77-41,
and Government Code Sections 65971 et seq., and,
WHEREAS, the Council of the City of Gilroy fixed
March 17, 1986 at 8:00 o'clock p.m., in the Council Chambers
in the City Hall at 7351 Rosanna Street, Gilroy, California,
as the time and place for a public hearing on said application,
due notice of said hearing has been given and said hearing has
been held;
The Council does hereby find from the evidence submitted
with the application and testimony given at the hearing that:
1. All schools in the district are impacted.
2. All reasonable mitigation measures have been
considered by the School District.
3. Ordinance No. 77-41 was adopted pursuant to
Government Code Section 65974 on November 21, 1977, more than
30 days prior to this resolution.
4. Location of temporary or portable buildings on
present school sites is consistent with the Gilroy General Plan.
5. The suggested impact fees of $2,712.00 per family
residential unit are reasonable based on five annual lease
payments for interim facilities needed by the School District.

NOW, THEREFORE, BE IT RESOLVED by the Council of
the City of Gilroy that all schools in the Gilroy Unified
School District are impacted under the provisions of
Ordinance No. 77-41, and impact fees to be assessed on new
construction are fixed at $2,712.00 per family residential
unit until further- order of the Council.
PASSED AND ADOPTED this 3rd day of March 1986 by
the following vote:

PALMERLEE, VALDEZ and HUGHAN
