RESOLUTION NO. 86-26
RESOLUTION OF THE COUNCIL OF THE CITY OF
GILROY APPROVING A TENTATIVE MAP FOR 70
RESIDENTIAL LOTS ON 18 ACRES, MORE OR LESS,
WEST OF THIRD STREET FROM UVAS CREEK TO CYPRESS
COURT AND EAST OF SANTA TERESA BOULEVARD.
WHEREAS, application TM 86-1 has been made by
JOHNSON ROSE CORPORATION, to the Planning Commission for
approval of a tentative map for 70 residential lots on
18 acres, more or less, west of Third Street from Uvas
Creek to Cypress Court and east of Santa Teresa Boulevard,
and
WHEREAS, after a public hearing the Planning Commission
has passed a Resolution in which it recommends approval of
the tentative map subject to twenty-six conditions, and
WHEREAS, the Council has approved a Negative
Declaration under the California Environmental Quality Act and
has held a public hearing on the application and has considered
the Planning Commission recommendation and the evidence presented;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Gilroy that:
1. The Negative Declaration is approved including
mitigation measures applied to reduce significant adverse
affects on the environment.
2. The tentative map for 70 lots is approved subject
to the following twenty-five conditions:
1. Street alignments connecting to adjoining
developments shall be coordinated with
and approved by the Director of Public Works.
2. Street improvements and the design of all
storm drainage, sewer lines, and all street
sections and widths shall be subject to the
approval by the Director of Public Works.

3. As soon as possible and before issuance
of any building permits for the projectl
during ~eriod~ of legally authorized
school l1npactJ.onl the developer shall
negotiate with the Gilroy Unified School
District and the City of Gilroy to
mitigate school impaction in lieu of,
or in addition to the required impact fees.
4. Existing mature specimen trees and shrubs
native to the area shall be preserved wherever
possible.
5. Grading operations and soil compaction
activities shall meet the approval of the
Director of Public Works.
6. All utilities to, through, and on the site
shall be installed underground.
7. An all-weather road surface shall be provided to
the lots prior to construction, subject to
the approval of the Director of Public Works
and the Fire Department.
8. Adequate turn around space shall be provided
for any cul-de-sac to meet the City of Gilroy's
Fire Department standards and approval.
9. Fire access, hydrant locations, and water main
sizing shall be approved by the Gilroy Fire
Department prior to the issuance of any
building permits.
10. Any existing water wells shall be sealed to
meet the approval of the Director of Public
Works and the Santa Clara Valley Water District
(SCVWD) .
11. The developer shall negotiate rights-of-way with
Pacific Gas & Electric Company and other utilities.
12. All building pads shall be raised at least
one foot above the 100-year flood elevation.
13. Additional turning lanes and channelization
will be required at the intersection of Uvas
Park Drive and Santa Teresa Boulevard subject
to the approval of the Director of Public Works.
14. Third Street shall be connected to Santa Teresa
Boulevard during the first phase of construction.

15. The proposed access ~rom Third Street
to Santa Teresa Boulevard shall conform
to the County's access policy and have
the approval of the Director of Public
Works, City of Gilroy.
16. The developer shall improve Uvas Park
Drive from Laurel Drive to Santa Teresa
Boulevard during the second phase of
construction, subject to the approval of the
Directors of Public Works and Planning.
17. The developer shall dedicate the Uvas Park
Drive right-of-way and public facility
zoned land, to the City of Gilroy, subject
to the approval of the Director of Public Works.
18. All single family residential lots shall
have a minimum size of 6,000 square feet,
as required by the City's Zoning Ordinance.
19. The placement of turning lanes and channelization
shall be required at the intersection of
Uvas Drive and Third Street, subject to the
approval of the Director of Public Works.
20. The developer shall improve Uvas Park Drive
with a six (6) foot high sound wall, in
addition to proposed lots numbered #56, 57,
and 58, to the rear of homes fronting Sequoia
Drive.
21. The developer shall obtain dedication for
the full width of Benassi Drive adjacent to
the project site before the first phase of
construction, and shall improve Benassi Drive
during the first phase.
22. Street names shall be subject to approval by
the City Public Works Department.
23. Any proposed retaining wall must be constructed
of permanent materials, such as concrete or
masonry; wood shall not be permitted.
24. Sewer allotment shall be assigned to this
project, and the applicant shall sign a
sewer allotment agreement prior to issuance
of any building permits.

25. The developer shall provide ~or
additional archaeological reconnaissance
in the area identified as CA-SCI-555, as
stated within a May 1984 archaeological
report prepared for the project site, prior
to the issuance of any grading or construction
permi t.
