RESOLUTION NO. 86~34
RESOLUTION SUPPORTING PROPOSITION 51
WHICH APrORTIONS GENERAL DAMAGE AWARDS
AMONG DEFENDANTS ACCORDING TO FAULT.
WHEREAS, in recent years a defendant one per-
cent at fault can be required to pay 100 percent of general
damages, and
WHEREAS, this patently unfair "deep pocket" rule
has been abused to the detriment of cities and has caused
liability insurance coverage problems, and
WHEREAS, Proposition 51 would remedy some of the
inequity of the "deep pocket" rule as to the award of general
damages by limiting the award to the percentage of responsibility.
NOW, THEREFORE, BE IT RESOLVED, that the City
Council of the City of Gilroy goes on record in support of
Proposition 51.
PASSED AND ADOPTED this 2nd day of June 1986 by
the following vote:
