RESOLUTION NO. 86-47
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ORDERING VACATION OF A TRIANGULAR PORTION OF THE
RIGHT OF WAY ON THE EAST SIDE OF CHESTNUT STREET,
SOUTH OF ITS INTERSECTION WITH BANES LANE MEASURING
14 FEET BY 252 FEET
WHEREAS, the Council of the City of Gilroy did on
July 21, 1986, adopt Resolution No. 86-42 declaring its
intention to proceed under the Public Streets. Highways
and Service Easements Vacation Law to vacate a triangular
portion of the right of way on the east side of Chestnut
Street, south of its intersection with Banes Lane measuring
14 feet by 252 feet, as shown upon the map attached hereto;
and
WHEREAS, notices of the adoption of such resolution
were published and posted as required by law; and
WHEREAS, no objection to the proposed vacation was filed
at or before the hearing by the Council on August 18, 1986, at
8:00 o'clock p.m., in the Council Chambers in the City Hall
at 7351 Rosanna Street, Gilroy, California, the time and place
fixed for the hearing in said notices, and the hearing having
been duly held, and the Council having duly considered the
evidence presented as to the vacation described herein;
The Council does hereby find that the described triangular
portion of the right of way on the east side of Chestnut
Street, south of its intersection with Banes Lane is unnecessary
for present or prospective public use.

NOW, THEREfORE, BE IT RESOLVED by the Council of;
the City of Gilroy that the described triangular portion
of the right of way on the east side of Chestnut Streett
south of its intersection with Banes Lane be vacated.
PASSED AND ADOPTED this 18th day of August 1986, by
the following vote:
