"' RESOLUTION NO. 86-76 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY APPROVING A TENTATIVE MAP FOR 16 RESIDENTIAL LOTS ON 3.3 ACRES, MORE OR LESS, ON THE EAST SIDE OF MURRAY AVENUE, NORTH OF LEAVESLEY ROAD. WHEREAS, application TM 86-5 has been made by SOUTH COUNTY HOUSING, to the Planning Commission for approval of a tentative map for 16 residential lots on 3.3 acres, more or less, on the east side of Murray Avenue, north of Leavesley Road, and WHEREAS, after a public hearing the Planning Commission has passed Resolution No. 86-35 in which it recommends approval of the tentative map subject to twenty-five conditions, and WHEREAS, the Council has approved a Negative Declaration under the California Environmental Quality Act and has held a public hearing on the application and has considered the Planning Commission recommendation and the evidence presented; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy that: 1. The prior Negative Declaration of August 18, 1986, is approved including six mitigation measures applied to reduce significant adverse affects on the environment. 2. The tentative map for 16 lots is approved subject to the following twenty-five conditions, including the modification of #7. by the Planning Commission: 1. The street alignment connecting to Murray Avenue shall be coordinated with and approved by the City Engineer. 2. Street improvements and the design of all storm drainage, sewer lines, and all street sections and widths shall be subject to the approval of the City Engineer. RESOLUTION NO. 86~76 -1- . . 3. An all-weather access~ to each building pad~ for fire engines shall be provided before commencing any combustible construction. Fire hydrants shall also be installed and maintained before combustible construction begins, to meet the approval of the City Fire Department. 4. Hydrant locations, and water main sizing shall be approved by the Gilroy Fire Department prior to the issuance of any building permits. 5. The developers shall negotiate rights-of-way with Pacific Gas & Electric and other utilities. 6. No construction shall occur within the existing Pacific Gas & Electric easement (located between proposed lots numbered 5 & 6 and 11 & 12), except as reviewed and approved by the City of Gilroy Planning and Building Departments, and the Pacific Gas & Electric Company. 7. All utilities through and on the site shall be installed underground, and utilities to the site shall be subject to the approval of the Department of Public Works. 8. Public utility easements shall be provided for storm drain, sewer lines, and water lines. 9. The street name shall be subject to approval by the City Public Works and Planning Departments. 10. Existing specimen trees native to the area shall be preserved wherever possible. 11. As soon as possible and before issuance of any building permits for the project, during periods of legally authorized school impaction, the developer shall negotiate with the Gilroy Unified School District and the City of Gilroy to mitigate school impaction in lieu of, or in addition to the required impact fees. 12. All grading operations and soil compaction activities shall meet the approval of the City Engineer. 13. All lots shall drain to the street for storm drainage. 14. All existing water wells shall be ~ealed to meet the approval of the City Engineer and the Santa Clara Valley Water District (SCVWD). RESOLUTION NO. 86-76 -2- . . 15. Storm drainage design and improvements shall be provided by the developer subject to the review and approval by the City of Gilroy Department of Public Works, and the Santa Clara Valley Water District. 16. Sewer allotment shall be assigned to this project, and the applicant shall sign a sewer allotment agreement prior to issuance of any building permits. 17. All single family residential lots shall have a minimum size of 6,000 square feet, as required by the City's Zoning Ordinance. 18. Development of the 16 single family lots, to include the design layouts and specific site considerations, shall be addressed fully within a required Architectural and Site Review application of the City of Gilroy. 19. The development of proposed lots numbered seven, eight, nine, and ten (#7,8,9, and 10) shall be subject to special noise attenuation measures as may be required under Architectural and Site Review. 20. The developer shall install an eight (8) foot high masonry sound wall along the entire easterly property line facing the South Valley Freeway (State Highway 101), subject to the review and approval from of the Planning, Building, and Public Works Departments. 21. The developer shall install drought tolerant, low- maintenance landscaping along the easterly side of the required sound wall (as required in condition number twenty (20) above), subject to the review and approval from the Planning Department and the Santa Clara Valley Water District. 22. A minimum fifteen (15) foot wide storm drain easement (8TM) shall be required between lots numbered eight (8) and nine (9). The final width of the STM easement shall be subject to the approval of the City Engineer. 23. Each lot shall be designed with a street fron~tage of not less than forty (40) feet. 24. All building pads shall be raised at least one foot above existing grade level, or higher as may be determined by the City Engineer. 25. All grading adjacent to the Ronan drainage Channel shall be done in accordance with Santa Clara Valley Water District approval and SCVWD Detail Sheet 20-20B. RESOLUTION NO. 86-76 -3- . .
