RESOLUTION NO. 87-11
RESOLUTION OF THE CITY OF GILROY APPROVING AN RH
PLANNED UNIT DEVELOPMENT SUBJECT TO COMPLIANCE
WITH THE PLANS, SPECIFICATIONS AND DESIGNS FILED WITH
THE APPLICATION, AND THE CONDITIONS IMPOSED HEREIN,
FOR DEVELOPMENT OF THAT 200' x 200' PARCEL LOCATED
ON WELBURN AVENUE NEAR RANCHO REAL.
WHEREAS, DONALD CHRISTOPHER has heretofore filed with
the Planning Commission of the City of Gilroy application
A/S 87-2 requesting approval of a Planned Unit Dsvelopment
design for RH (Hillside Residential) development of a single
family lot located on Welburn Avenue near Rancho Real, and
WHEREAS, the Planning Commission of the City of Gilroy
has heard the application at its February 5, 1985 meeting,
has approved a Categorical Exemption for the project under the
California Environmental Quality Act and has made its report
to the Council of the City of Gilroy, in which it recommends
approval of the RH Planned Unit Development design, subject
to certain conditions, and
WHEREAS, the Council of the City of Gilroy agendized
the application for consideration at its regular meeting of
February 17, 1987, and the Council having duly considered
the application, the report of the Planning Commission and
the evidence presented, the Council does hereby determine:
1. That the Council notes the Environmental Impact
Report under the California Environmental Quality Act.
2. That the Council approves and adopts the findings
of the Planning Commission set forth in Zoning Ordinance
Section 50.55.

3. That the Planned Unit Development be approved
subject to the conditions set forth below.
NOW~ THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF GILROY that the Planned Unit Development design be
approved for the premises described below, subject to the
following conditions:
1. Landscaping: Existing ground cover shall be
maintained to the greatest extent possible. All
grading and cut and fill areas shall be landscaped
during and after construction to prevent erosion
and to increase slope stability. Native vegetation
shall be protected from damage during construction.
A description and plan shall be submitted as required
by the Planned Unit Development approval procedure
showing the location and type of plant material to be
installed, acoording to Landscaping Policy. In
designing landscaping~ drought~resistant plants will
be considered the greatest priority. All plantings
within 30 feet of the building must be fire-resistant.
2. Exterior Lighting: No unobstructed beam of exterior
lighting shall be directed outward from the site
toward any residential use or public right-of-way.
3. The developer/applicant must obtain a sewer allotment
for this project, and sign a sewer allotment agreement
prior to the issuance of any building permits.
4. Color and materials used for buildings shall be
compatible with the natural landscape.
5. All earthwork and construction shall comply with the
recommendations of the Soil Investigation prepared
by Nordmo Associates, Inc. for this site. Further
investigation shall be required to pinpoint the location
of the suspected faultline which may traverse the
west portion of this property. Recommendations for
building setbacks and engineering for the proposed
building may be amended as a result of this investigation.
6. The foundation design based on soils tests shall be
approved by the City Engineer in order to preserve
the integrity of the hillside slope.
7. The chimneys shall be equipped with spark arresters
and shall not be located within 10 feet of trees.

8. Exterior antennas shall not be permitted.
9. The house number shall be clearly visible at the
entrance to the access road off of Welburn Avenue.
10. All utility service lines shall be underground.
11. Water; Water mains and a fire hydrant (if
necessary) shall be installed and approved prior
to commencing construction with combustible
materials. If pressure booster pumps are necessary,
they shall be paid for by the developer.
12. The house shall be sprinklered to meet Fire
Department regulations.
13. All roofing material shall be non-combustible
material subject to the approval of the Fire
Department.
14. Driveway: A cross access easement shall be recorded
prior to issuance of building permits to provide
the property owner on parcel 783-23-66 access along
the common driveway area between the two parcels.
15. All grading and erosion control plans are subject
to approval by the Public Works Department prior to
issuance of building permits.
