RESOLUTION NO. 87-13
A RESOLUTION AFTER PUBLIC HEARING, OF THE CITY
OF GILROY WITH REGARD TO A REORGANIZATION DESIGNATED
AS "BVENA VISTA-LAS ANIMAS REORGANIZATION 86...2"
BE IT RESOLVED AND FOUND BY THE CITY COUNCIL OF THE
CITY OF GILROY, AS FOLLOWS:
1. That the City of Gilroy is the conducting agency
for proceedings to reorganize the territory described in
Exhibit "All attached hereto and incorporated herein and
designated as "BUENA VISTA..LAS ANIMAS REORGANIZATION 86-2".
2. That the City Council on February 2, 1987, passed
Resolution No. 87-4 initiating the reorganization of the subject
terri.tory.
3. That the territory which the petitioners request
be annexed to the City of Gilroy, and which the City Council
proposes to annex and to detach from the South Santa Clara County
Fire District, is contiguous to the city limits of the City,
contained less than 12 registered voters at the time the petition
was filed, and is uninhabited territory.
4. That said petition does not contain the written
consent of all of the land owners to the annexation.
5. That the Council has previously certified an
Environmental Impact Report with 10 mitigation measures and a
statement of overriding considerations for this specific project.
6. The Council finds that:
a. The unincorporated territory proposed for
annexation is within Gilroy's Urban Service
Area as adopted by the Santa Clara County
(LAFCO, (Local Agency Formation Commission).

b. The annexation proposed will not split any line
of assessment or property ownership.
c. The County Surveyor has determined the boundaries
of the proposal to be definite and certain, and
in compliance with the road annexation policies
as adopted by the Santa Clara County LAFCO, (Local
Agency Formation Commission).
d. The annexation proposed will not create any
islands or areas in which it would be difficult
to provide municipal services.
e. The annexation proposal is consistent with
Gilroy's General Plan Land Use Map.
f. The annexation proposal is consistent with the
intent of the goals and policies of the General
Plan document; and
g, The unincorporated territory proposed for
annexation is contiguous to existing City limits.
7. That the City Council, as conducting agency, has
also duly performed the following:
a. The Council has initiated and completed
reorganization proceedings.
b. The territory described in Exhibit "A"
hereto is ordered reorganized and is
organized to include the following changes
of organization.
i. Annexation to the City of Gilroy
ii. Detachment from the South Santa Clara
County Fire District.
c. The City of Gilroy, as conducting agency, reorganized
such territory as indicated above after a duly
noticed public hearing this date, and without election,
it being found, and concurred in that the territory
described in Exhibit "A" is uninhabited, and no
written protests to the reorganization of the
described territory were filed prior to the public
hearing.
8. That the herein described reorganization and each
of the actions of the City of Gilroy herein described were in
full accordance with the Cortese-Knox Local Government

which is part thereof.
