Resolution 1987-20 . . ~ - RESOLUTION NO. 87~20 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY MODIFYING ON APPEAL RESOLUTIONS OF THE PLANNING COMMISSION GRANTING A VARIANCE AND CONDITIONAL USE PERMIT TO ALLOW SIGNS WITH SPECIFIC CONDITIONS FOR LEAVESLEY INN, APPLICANT. WHEREAS, COUNCILMEMBER SHARON A. ALBERT has filed an appeal in due form from the action of the Planning Commission of the City of Gilroy granting a variance for two 25 square foot monument signs, one 10 feet high on Leavesley Road, and the other 7 feet high on Murray Avenue for common use with the frontage parcels, and a conditional use permit for an on-site 150 square foot freestanding sign at the south end of the motel building, conditioned on there being only one other future freeway sign on the Murray Avenue frontage properties under common ownership, all at the northeast corner of LEAVESLEY ROAD and MURRAY AVENUE, and notice of the hearing of said appeal has been given in the manner required by law and the Zoning Ordinance of the City of GilroYi and WHEREAS, the said hearing on the appeal has been held on April 6, 1987 at 8:00 p.m. in the Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California, and evidence was submitted upon the said application and appeal from the findings of the Planning Commission, the City Council finds: 1. The findings of the Planning Commission are hereby approvedi and 2. The Planning Commission did not err in granting the application, but should have imposed modified conditions. RESOLUTION NO. 87-20 -1- . . .. .- THEREFORE, BE IT RESOLVED that the actions of the Planning Commission are hereby modified as to certain conditions, and as modified, are affirmed: 1. As to Resolution 87~7 granting the variance, there may be two 35 square foot signs both 7 feet high, with the sign on Leavesley Road to be temporarily 10 foot high and to be lowered to 7 feet when the obstruction is removed, with no common use requirement. 2. As to Resolution 87-6 granting the conditional use permit, there should be no condition as to future freeway signs at this time.
