RESOLUTION NO. 87 - 48
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING
UNIFORM FIRE CODE, 1985 EDITION, WITH MODIFICATIONS
WHEREAS, Section 10.9 of the Gilroy City Code provides that the
latest edition of the Uniform Fire Code shall be submitted to the
Council to become effective within the City upon approval by
resolution, subject to possible modifications and amendments; and
WHEREAS, the 1985 Edition of the Uniform Fire Code has been
submitted and recommended by the Fire Chief for Council approval,with
modifications.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
GILROY that the Uniform Fire Code, including Appendices IC, IIA, B, D,
IlIA, B, C, IVA, VA, VIA, C, D, and VII, and any fees or charges set
forth therein is adopted and shall apply within the City of Gilroy
with the following modifications.
Sec. 2.105
The Chief and members of the Fire Department shall have
the powers of a police officer in performing their
duties under this code.
Sec. 2.201(a) Members of the Fire Department shall inspect, as often
as may be necessary, all buildings and premises ."
Sec. 2.302 The Board of Appeals used by the City Building
Department shall be the same appeals board used by the
Fire Department.
Sec. 4.101 A permit shall be obtained from the Bureau of Fire
Prevention prior to engaging in the following
activities, operations, practices, or functions, when
required by the Chief:
Sec. 4.101 Add #48 - Permits Required But Not Listed - Whenever, in
this code, a permit is required but is not listed in
this Article, it shall be treated as if listed in this
Article.
Sec. 4.102(b) A permit issued under this code shall be in effect for a
period not to exceed 1 year from date of issue but may
be restricted to a lesser time. Permits issued under
this code may be revoked for cause, and are not
transferable. Any change in use, occupancy, operation
or ownership shall require a new permit.
Sec. 9.102 Change to 9.102(a) and add 9.102(b). Where terms are
not defined, they shall have their ordinarily accepted
meanings within the context with which they are used.
For the purpose of this section Webster's Third New
International Dictionary of the English Language,
Unabridged, Copyright 1981, shall be used and shall be
considered as providing ordinarily accepted meanings.
Sec.10.207(b) Fire apparatus access roads shall be required for every
building hereafter constructed when any portion of an
exterior wall of the first story is located more than
150 feet from Fire Department vehicle access, as
measured by an unobstructed route around the exterior of
the building.

Add:
Sec.10.210
When deemed necessary to provide for protection of life
or property, the Chief may require the owner or operator
of any occupancy regulated by this code to develop and
implement a pre-fire and emergency plan.
Sec.10.301(c) Water Supply - An approved water supply capable of
supplying required fire flow for fire protection shall
be provided to all premises upon which buildings or
portions of buildings are hereafter constructed. When
any portion of the building protected is in excess of
150 feet from a water supply on a public street, as
measured by an unobstructed route around the exterior of
the building, there shall be provided, when required by
the Chief, on-site fire hydrants and mains capable of
supplying the required fire flow.
Sec.lO.301(d) When fire protection facilities are to be installed by
the developer, such facilities including all surface
access roads, water supply and fire hydrants shall be
installed prior to construction and maintained during
construction. When alternate methods of protection, as
approved by the Chief are provided, the above may be
modified or waived.
Add:
Sec.10.302(c) The owner of a fire alarm system shall provide for the
proper testing and servicing of the system. Testing and
servicing shall be performed by a qualified technician.
Testing and servicing shall be performed no less than
annually. It is the responsibility of the owner to
provide proof of testing and servicing to the Chief upon
request.
Add:
Sec.10.306(a)3 In any apartment or hotel or similar use, where a fire
alarm system is required by this code, all buildings,
regardless of number of units, shall have fire alarm
systems installed. Fire alarm systems shall be
monitored at a constantly attended location.
Add:
Sec.10.306(f) Area separation walls, as defined by the Uniform
Building Code, shall not be used to exempt the
installation of fire alarms.
Sec.10.308(b) Changed to read: All occupancies. An automatic
sprinkler system shall be installed:
Sec.10.308(b).5 Add to read: In any building or group of buildings
where in the judgement of the Fire Chief, such buildings
or group of buildings due to size, height, type of
construction, location on property, contents or
occupancy classification would exceed or severely tax
the capabilities of the local fire department to perform
a reasonable level of rescue and fire suppression. Fire
flow for each building will be determined utilizing the
Insurance Services Office basic fire flow formula.

Regardless of area or occupancy separation walls, when more than 1500
gallons per minute fire flow is required, the building shall be
equipped with an automatic fire sprinkler system. Such buildings
shall include, but not be limited to:
A. all buildings more than three stories or thirty feet in
height; or
B. buildings where limited access for fire apparatus does not
permit mobile unit operations of ladder companies to within
fifteen (15) feet of openings in stories as required in UBC
504 and 3802; or
C. buildings where limited access for fire apparatus does not
permit mobile use of pump and hose companies to reach all
sides of the building without hand laying more than 150 feet
of fire hose.
D. If a fire sprinkler system is not required for purposes
other than this section, the area increases specified in
Section 506(c), the height and story increase specified in
Section 507 and the fire-resistive substitution in 508 of
the Uniform Building Code may be permitted.
E. additions to existing buildings: this section shall apply
to all additions to existing buildings.
1. if the entire building area, including the addition,
exceeds the area permitted in Section 3802(a) through
3802(g) of the Uniform Building Code, then the entire
building shall be sprinklered; or
2. if the entire building area, including the addition,
requires an automatic sprinkler system by this section,
but the entire building is below the area specified in
Section 3802(a) through 3802(g), the addition shall be
equipped with an automatic sprinkler system and be
separated from the existing building by an area
separation wall as specified in 505(e) of the Uniform
Building Code.
F. This section shall not be applicable to R-1 and R-3
buildings under five thousand (5,000) square feet in area.

Sec.10.308(h) All structures and buildings required to be sprinklered
shall be sprinklered in accordance with the design
criteria for Ordinary Group III, if the structure or
building is constructed within the following zoning
classifications: CM Commercial Industrial, M-1 Limited
Industrial, M-2 General Industrial.
Add:
Sec.10.308(i) Regardless of any other provision of this section, all
buildings three stories or greater in height shall be
protected by an approved fire sprinkler system.
Sec.10.309
Automatic sprinkler systems shall be supervised by an
approved central proprietary or remote station service
or a local alarm which will give an audible signal at a
constantly attended location.
Exception: Fire sprinkler systems supplied by
domestic water supply.
Sec.10.311
Occupancy #2. Occupancies 3 stories or more but less
than 150 in height, except Group R, Div. 3.
Sec.45.207
Limited spraying (spotting or touch-up) shall be
conducted only in approved spray booths or spraying
rooms.

The storage of flammable and combustible liquids as
defined in Section 9.105 and 9.108 in outside, above
ground tanks and underground tanks is prohibited in the
following zones: RH, RI, R2, R3, PO, C1, C2, and C3 as
defined in the City of Gilroy Zoning Map.
Add:
Sec.79.101(e) The production or manufacture of flammable or
combustible liquids as defined in Section 9.105 and
9.108 from stills or condensers is prohibited in the
following zones: RH, R1, R2, R3, R4, PO, C1, C2, and C3
as defined in the City of Gilroy Zoning Map.
Add:
Sec.79.903(b) 1: When an attendant cannot fulfill the duties of
Section 79.903(b), such as might be expected in a m1n1-
mart/service station operation, an approved automatic
fire extinguishing system shall be installed at the pump
islands or a second attendant shall be provided to
fulfill the duties set forth in Section 79.903(b).
Add:
Sec.82.105(g) The storage of liquid petroleum gases,is prohibited in
areas zoned as RH, R1, R2, R3, R4 and PO as defined in
the City of Gilroy Zoning Map.
EXCEPTION: 1. containers used for torches and
similar uses
2. portable containers in bar-b-ques, camp
stoves, recreation vehicles, and
similar uses
3. motor vehicle fuel tanks
Add Sec. 24 to
Appendix IIA: ROOF COVERINGS
Regardless of requirements contained in Section
3202(a,b, and c) of the 1985 Uniform Building Code, all
roof coverings on buildings hereafter constructed in
areas of the City that have been designated to be a
hazardous fire area due to vegetation, topography, water
supply or access, shall have roof coverings as specified
in Section 3203 (e), 1 through 11 of the 1985 Uniform
Building Code. Refer to hazardous fire area maps on
file in the City of Gilroy Planning Department, Building
Department and the Fire Department.
Add:
Appendix VII
High Rise Buildings: There is added to the Uniform Fire
Code, as appendix VII, part 2, Title 24 CAC, Chapter 2-
18. As part of the Uniform Fire Code, the Appendix
shall serve as the City's High Rise Regulations. Title
24 CAC, Chapter 2-18, Section 2-1807(a)1 is amended to
read "------This section shall apply to every new
building of any type construction or occupancy having
floors used for human occupancy located more than 50
feet above the lowest floor level having building
access."
A copy of this resolution shall be kept in the
office of the Fire Chief for examination by interested persons.
