RESOLUTION NO. 87-55
RESOLUTION OF THE COUNCIL O~ THE CITY OF GILRQ~
DISAPPROVING ON APPEAL RESOLUTION NO. 87~16 OF
THE PLANNING COMMISSION GRANTING CONDITIONAL USE
PERMIT FOR A COUNSELING CENTER IN AN R2 DISTRICT
WHEREAS, an appeal in due form has been filed from
Resolution No. 87-16 of the Planning Commission of the City
of Gilroy granting to SOUTH COUNTY ALTERNATIVES a conditional
use permit for a counseling center in an R2 district at Forest
and Martin Streets in the City of Gilroy, and notice of the
hearing of said appeal has been given in the manner required
by law and the Zoning Ordinance of the City of GilroYi and
WHEREAS, the said hearing on the appeal has been held
on July 20, 1987, at 8 p.m. in the Council Chambers in the City
Hall at 7351 Rosanna Street, Gilroy, California, and evidence
was submitted upon the said application and the appeal from the
findings of the Planning Commission, the City Council finds:
(1) The proposed use is not compatible with the General
Plan.
(2) Increase in traffic will exacerbate existing traffic
problems in the area.
(3) The proposed use is not compatible with and will
adversely affect other residential property in the vicinity or
cause damage, hazard or nuisance to persons or propertYi and
WHEREAS, the Planning Commission erred in granting the
conditional use permit, it shall be and the same is hereby denied.
PASSED AND ADOPTED this 20th day of July, 1987, by the
