RESOLUTION NO, 87",61
A RESOLUTION AFTER PUBLIC HEARING, OF THE CITY
OF GILROY WITH REGARD TO A REORGANIZATION DESIGNATED
AS "SUNRISE DRIVE REORGANIZATION 86-3 n
BE IT RESOLVED AND FOUND BY THE CITY COUNCIL OF THE
CITY OF GILROY, AS FOLLOWS:
1. That the City of Gilroy is the conducting agency
for proceedings to reorganize the territory described in
Exhibit "A" attached hereto and incorporated herein and
designated as "SUNRISE DRIVE REORGANIZATION 86-3.'.
2. That the City Council on Jiuly 20, 1987 passed
Resolution No.87_56initiating the reorganization of the subject
territory.
3. That the territory which the petitioners request
be annexed to the City of Gilroy, and which the City Council
proposes to annex and to detach from the South Santa Clara County
Fire District, is contiguous to the city limits of the City,
contained less than 12 registered voters at the time the petition
was filed, and is uninhabited territory.
4. That said petition does not contain the written
consent of all of the land owners to the annexation.
5. That the Council has previously approved a Negative
Declaration with mitigation measures for this proposed
annexation and reorganization.

The Council finds that:
a.
The unincorporated territory proposed for
annexation is within Gilroy's Urban Service
Area as adopted by the Santa Clara County
LAFCO, (Local A~ency Formation Commission).

b.
The annexation proposed will not split any line
of assessment or property ownership.
The County Surveyor has determined the boundaries
of the proposal to be definite and certain, and
in compliance with the road annexation policies
as adopted by the Santa Clara County LAFCO, (Local
Agency Formation Commission).
The annexation proposed will not create any
islands or areas in which it would be difficult
to provide municipal services.
The annexation proposal is consistent with
Gilroy's General Plan Land Use Map.
The annexation proposal is consistent with the
intent of the goals and policies of the General
Plan document; and

The unincorporated territory proposed for
annexation is contiguous to existing City limits.
That the City Council, as conducting agency, has

also duly performed the following:
a. The Council has initiated and completed
reorganization proceedings.
b. The territory described in Exhibit "Alt
hereto is ordered reorganized and is
organized to include the following changes
of organization.
i. Annexation to the City of Gilroy
ii. Detachment from the South Santa Clara
County Fire District.
c. The City of Gilroy, as conducting agency, reorganized
such territory as indicated above after a duly
noticed public hearing this date, and without election,
it being found, and concurred in that the territory
described in Exhibit "A" is uninhabited, and no
written protests to the reorganization of the
described territory were filed prior to the public
hearing.
8. That the herein described reorganization and each
of the actions of the City of Gilroy herein described were in
full accordance with the Cortese-Knox Local Government

which is part thereof.
PASSED AND ADOPTED this 17th day of August, 1987 by

BEING all of the 11.00 acre and the 14.98 acre parcel of land as
shown on Record of Survey Map filed fo~ record in Book 19 of Maps
at page 6 and all of Parcels 1, 2 and 3 as shown on Record of
Survey Map filed for record in Book 425 of Maps at page 7,
Records of Santa Clara County, California and being more
particularly described as follows:
BEGINNING at the southwesterly corner to' Parcel 3 as shown on
said Record of Survey Map, being at an angle point in the
boundary of "Northwest Annexation 65-1 to the City of Gilroy as
described in Resolution 65-1 of said City adopted September 7,
1965, from which the southwesterly corner of said Annexation
bears S. 720 24' 35"W.' 3224.82 feet, and running thence along the.
southerly boundary of said Parcels 1, 2 and 3 and a boundary of
said annexation S.890 46'33"E. 2367.90 feet to the southeasterly
corner to Parcel 1 in the centerline of Santa Teresa Boulevard
(formerly Morey Avenue); thence continuing along the prolongation
of said southerly line S.890 46'33"E. 55.19 feet to an
intersection with the easterly line of Santa Teresa Blvd. as
shown on Record of Survey Map filed for ~ecord in Book 478 of
Maps at pages 14 thru 20, Records of Santa Clara County; thence
along said easterly line N.4055'54"E. 151.81 feet, N.3047'43"E.
605.12 feet, N.4055'55"E. 182.04 feet and N.6023'52"E. 19.52 feet
to an intersection with the easterly prolongation of the
northerly line of the Record of Survey Map first above referred
to; thence along said prolongation N.89045'13"W 43.65 feet to the
centerline of Santa Teresa Boulevard at an angle point in the
boundary of said "Northwest Annexation 65-1"; thence along the
northerly line of said Record of Survey Map and the boundary of
said Annexation N.890 45'13"W. 2366.31 feet to the northwesterly
corner of said Map; thence still along said Annexation bo~ndary
and the westerly line of said Record of Survey Maps S.5001'18"W.
