RESQLUTION NO, 87~65
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ORDERING VACATION OF AN EASEMENT FOR CONSTRUCTING
AND MAINTAINING A LEVEE ON OLD ORCHARD CQMP Am
TRACT 7988.
WHEREAS, the Council o~ the City o~ Gilroy did on
August 17, 1987 adopt Resolution No. 87~58 declaring its
intention to proceed under the Public Streets, Highways
and Service Easements Vacation Law to vacate an easement
for constructing and maintaining a levee on Old Orchard
Company Tract 7988 as shown upon the map attached hereto; and
WHEREAS, notices of the adoption o~ such resolution
were published and posted as required by law; and
WHEREAS, no objection to the proposed vacation was filed
at or before the hearing by the Council on September 21.. 1987,
at 8:00 p.m., in the Council ,Chambers in the City Hall at
7351 Rosanna Street, Gilroy, California, the time and place
fixed for the hearing in said notices, and the hearing having
been duly held, and the Council having duly considered the
evidence presented as to the vacation described herein;
The Council does hereby find that the described easement
for constructing and maintaining a levee on Old Orchard Company
Tract 7988 is unnecessary for present or prospective public use.
NOW.. THEREFORE.. BE IT RESOLVED by the Council o:e
the City of Gilroy that the described easement for constructing
