RESOLUTION NO. 88-48
RESOLUTION OF THE COUNCIL OF THE CITY OF
GILROY MODIFYING AND AFFIRMING ON APPEAL
THE ACTION OF THE PLANNING COMMISSION GRANTING
A PARKING VARIANCE FOR A SHOPPING CENTER SOUTH
OF TENTH STREET BETWEEN CHESTNUT AND ALEXANDER
STREETS
WHEREAS, COUNCILMEMBER DANIEL D. PALMERLEE has
filed an appeal in due form from the action of the Planning
Commission of the City of Gilroy granting a 38 space parking
variance for a 529 stall lot for the FILBRO DEVELOPMENT
COMPANY on Tenth Street between Chestnut and Alexander Streets,
and notice of the hearing of said appeal has been given in the
manner required by law and the Zoning Ordinance of the City
of Gilroy; and
WHEREAS, the said hearing on the appeal has been
held on August 1, 1988 at 8;00 p.m. in the Council Chambers
in the City Hall at 7351 Rosanna Street, Gilroy, California,
and evidence was submitted upon the said application and appeal
from the findings of the Planning Commission, the City Council
find s :
(1) The findings of the Planning Commission are
hereby disapproved in part; and
(2) The Planning Commission did not err in granting
the application, but should have imposed an additional condition.
THEREFORE, BE IT RESOLVED that the action of the
Planning Commission is hereby modified by adding the

following condition~ and as modified~ is affirmed:
The applicant shall work with staff
to develop at least 5 to 10 additional
parking spaces for compact autos.
