""- RESOLLUTlON NO. 88 - 53 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY OF INTENTION TO ESTABLISH THE "DOWNTOWN PARKING AND BUSINESS IMPROVEMENT AREA" IN THE CITY OF GILROY. (Streets and Highways Code Sections 36000, et seq.) WHEREAS! Part 5 of Division 18 of the Streets and Highways Code of the State of California (Section 36000, et seq.) authorizes cities to establish a "Parking and Business Improvement Area" and impose an assessment fee on businesses within the area, in addition to the general business license fees, if any, in the city, and to use such proceeds for the purposes therein provided; and WHEREAS, it appears in the public interest that such an area be established within the City of Gilroy; and WHEREAS, the Gilroy Downtown Development Corporation has petitioned this Council to establish said area. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY, AS FOLLOWS, TO WIT: 1. That this Council do, and it does hereby, declare its intention to establish the "Downtown Parking and Business Improvement Area" in the City of Gilroy pursuant to the provisions of Part 5 of Division 18 of the Streets and Highway Code of the State of California. 2. That the proposed boundary of said proposed "Downtown Parking and Business Improvement Area", including the designation of separate benefit zones, is as set forth in the description attached hereto and marked Exhibit A. 3. That a hearing shall be held by this Council to consider the proposed establishment of the "Downtown Parking and Business Improvement Area" on Monday, the 19th day of September, 1988, at the hour of 8:00 o'clock p.m., in the Council Chambers of City Hall, 7351 Rosanna Street, Gilroy, California. 4. That the proposed uses to which the proposed revenue from said assessment fees are to be put will be one or more or all of the following: (a) Acquisition, construction and maintenance of parking facilities for the benefit of the area; (b) Decoration of any public place in the area; -]- RESOLUTION NO. 88 - 53 . ,'~ . . " (c) Promotion of public events which are to take place on or in public places in the area; (d) Furnishing of music i.n any public place place in the area; (e) General promotion of retail trade activities in the area. 5.
