RESOLUTION NO. 89-22
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GILROY APPOINTING A RELOCATION APPEALS
BOARD
WHEREAS, the California Community Redevelopment Law
(Health & Safety Code Section 33417.5) requires that each city
having a redevelopment agency use a relocation appeals board
to hear complaints brought by residents relating to relocation
to determine if the redevelopment agency has complied with
applicable laws and regulations; and
WHEREAS, said law further requires that such Board be
composed of five members appointed by the Mayor of the City
and approved by the legislative body of the City; and
WHEREAS, the Mayor has nominated five members of the City
of Gilroy Planning Commission who are most senior in office
from time to time to serve as the members of the Relocation
Appeals Board. Seniority shall be based on length of
continuous service as a Planning Commissioner. If two or
more Commissioners possess equal seniority for the fifth
position of Relocation Appeals Board member, the Mayor, with
City Council approval, shall designate the Commissioner among
those with equal seniority to serve as the fifth member of the
Relocation Appeals Board.
BE IT NOW THEREFORE RESOLVED:
1. That the Planning Commission of the City of Gilroy is
hereby designated and appointed as the Relocation Appeals
Board of the City of Gilroy and that the Chairperson of the
Planning Commission is appointed Chairperson and Presiding
Officer thereof.
2. That said Board is authorized and directed to perform
all acts and duties required to be performed by a Relocation
Appeals Board under applicable laws and statutes.
