RESOLUTION NO. 89-45
RESOLUTION OF TIm CITY COUNCIL OF THE CITY OF GILROY
CALLING A SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE
OF SUBMITTING TO THE ELECTORS OF SAID CITY A REFERENDUM
QUESTION PERTAINING TO ORDINANCE NO. 89-12 ADOPTING A
COMMUNITY REDEVELOPMENT PLAN PURSUANT TO THE LAW OF THE
STATE OF CALIFORNIA; REQUESTING CONSOLIDATION OF
ELECTIONS WITH THE DIRECT GENERAL ELECTION TO BE HELD
NOVEMBER 7, 1989; AND REQUESTING SERVICES OF REGISTP~R
OF VOTERS
WHEREAS, a referendum petition was submitted to the office of
the City Clerk of the City of Gilroy protesting the adoption by the
Council of Ordinance No. 89-12 providing for the City of Gilroy
Community Redevelopment Plan, pursuant to the Community Redevelopment
Law of the State of California, which Ordinance was adopted by the
Council on the 5th day of July, 1989, to become effective on the 4th
day of August, 1989, which petition requests that Ordinance No. 89-12
be repealed by the Councilor submitted for determination by the voters;
and,
WHEREAS, the Council has reconsidered the adoption of said
Ordinance and after such reconsideration declines to repeal said
Ordinance; and,
WHEREAS, the said petition appears to be valid in form and the
City Clerk has made her certificate and attached it to the petition
showing that the petition has been signed by a sufficient number of
qualified electors of the City of Gilroy as required by law and that
said referendum petition should be placed upon the ballot for a
special Municipal Election.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GILROY as follows:
SECTION ~ A Special Municipal Election is hereby called in the
City of Gilroy to be held on November 7, 198"9, at which election there
will be submitted to the electors of said City a Referendum Question
pertaining to Ordinance No. 89-12 as set forth in Section 4 below.

SECTION 2. The Special Municipal Election hereby called is
hereby consolidated with the General Municipal Election to be held
in the City of Gilroy on November 7, 1989, and the precincts, polling
places and offices of election shall be the same as those established
and designated for said election by the Board of Supervisors of the
County of Santa Clara.
SECTION 3. Pursuant to Section 22003 of the Elections Code,
the City Council hereby requests the Board of Supervisors of the County
of Santa Clara to make available the services of the Registrar of
Voters for the purpose of performing the usual services in the conduct
of the Consolidated Election, including the provisions of election
supplies and voter's pamphlets.
The Board of Supervisors of the County of Santa Clara is hereby
authorized to canvass the returns of said election, and said
election shall be held in all respects as if there were only one
election, and only one form of ballot shall be used.
SECTION 4. The City Council does hereby further resolve that
it requests the Board of Supervisors of Santa Clara County for the
consolidation of said Special Municipal Election with the said
General Municipal Election and hereinafter sets forth the exact form
of the Referendum Question to be voted upon at such consolidated
election, as the same is to appear on the ballot, to wit~

SHALL ORDINANCE NO, 89-12 ADOPTING A YES
COMMUNITY REDEVELOPMENT PLAN PURSUANT TO THE
LAW OF THE STATE OF CALIFORNIA, BE ADOPTED? NO
SECTION 5. The City Clerk is hereby directed to file with the
Board of Supervisors and the Registrar of Voters of the County of
Santa Clara certified copies of this Resolution at least eighty-
eight (88) days prior to the herein referenced General Election.

SECTION 6. The City Clerk shall publish the Notice of said
Election as required by Section 22830 of the Elections Code.
SECTION 7. The City Attorney shall prepare an analysis of
the measure pursuant to Section 5011 of the Elections Code.
SECTION 8. The City Council hereby authorizes rebuttal
arguments to be filed in accordance with Sections 4015.15 and
5014.5 of the Elections Code, and establishes August 16, 1989 as the
deadline to file Arguments for or against the measures and August 21,
1989 as the deadline to file Rebuttal Arguments.
