RESOLUTION NO. 90-3
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
AFFI~1ING ON APPEAL THE ACTION OF THE PLANNING
COMMISSION DEFINING THE I.F.D.E.S. LODGE AS A
"CHURCH" WITHIN THE CONTEXT OF THE ZONING
ORDINANCE
vJHEREAS, COUNCILMEHBER PAUL KLOECKER filed an
appeal in due form from the action of the Planning Commission
of the City of Gilroy defining the Irmandade da Festa do
Divino Espirito Santo Lodge as a church within the context
of the Zoning Ordinance, and notice of the hearing of said
appeal has been given in the manner required by lRW and the
Zoning Ordinance of the City of Gilroy; and
HHEREAS, the said hearing on the appeal has been held
on January 2, 1990 at 8 p.m. in the Council Chambers in the
City Hall at 7351 Rosanna Street, Gilroy, California, and evidence
was submitted upon the said application and appeal from the
findings of the Planning Commission, the City Council finds:
(1) The findings of the Planning Commission are hereby
approved; and
(2) The Planning Commission did not err in the action
taken.
THEREFORE, BE IT RESOLVED that the action of the
Planning Commission is hereby affirmed.
PASSED AND ADOPTED this 2nd day of January 1990, by the
following vote:

NELSON, VALDEZ and HUGHAN
